<br />JAMES E. ROSS and JANET M. ROSS, husband and wife, each in

<br />his and her own right and as spouse of the other, of Grand

<br />Island, Nebraska, herein called the Grantors, in consid~

<br />receipt of which is hereby acknowledged, hereby grant and convey
<br />
<br />unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a municipal corporation, in Hall County, Nebraska, herein called
<br />
<br />the Grantee, a permanent and'perpetual easement and right-of-way
<br />
<br />to construct, operate, maintain, extend, repair, replace, and
<br />
<br />remove public utilities, including but not limited to, sanitary
<br />
<br />sewers, storm drainage system, manholes, surface markers, and
<br />
<br />other appurtenances, upon, over, in, and through a tract of land
<br />
<br />located in Lot Thirteen (13), Capital Heights Second subdivision
<br />
<br />in the eity of Grand Island, Nebraska, more particularly
<br />
<br />described as follows:
<br />
<br />The westerly eight (8) feet, except the northerly eight (8)
<br />feet of Lot Thirteen (13) of Ross Heights Second Sub-
<br />division, said tract containing 1,360 square feet (.03l
<br />acres), more or less, as shown on the plat marked Exhibit
<br />"A", dated October 22, 1984, attached hereto and incorpor-
<br />ated herein by reference;
<br />
<br />together with the following rights, namely, unrestricted ingress
<br />
<br />and egress under, over, and across such land for the purpose of
<br />
<br />exercising the rights herein granted, to clear and keep clear of
<br />
<br />trees, roots, brush, and other obstructions from the surface of
<br />
<br />such tract. Any such utilities and appurtenances placed upon,
<br />
<br />over, and under such tract of land shall remain the property of
<br />
<br />the Grantee and may be removed or replaced at any time.
