<br /> <br />L <br /> <br />~ <br />i <br /> <br />I <br /> <br />LICENSE AGREEMENT <br /> <br />B8-~ 100167 <br /> <br />This License Agreement is made by and between the CITY OF <br />GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred <br />to as the "City" and ART-KRAFT, INC., a Nebraska corporation, <br />hereinafter referred to as the "Licensee;'. <br /> <br />1. STATEMENT OF PURPOSE. The purpose of this License <br />Agreement is to set forth the terms and conditions under which <br />the Licensee may construct, maintain, repair, and utilize the <br />following described improvement which will infringe upon real <br />estate owned or controlled by the City: <br /> <br />Awning display and metal mansard to be located <br />at 715 West Anna Street, Grand Island, Hall County, <br />Nebraska. <br /> <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee <br />owns or controls the following described real estate adjacent to <br />the City's real estate to which this License Agreement shall apply: <br /> <br />A tract of land located in the Northeast Quarter of the <br />Northeast Quarter of Section Twenty-One (21), Township <br />Eleven North (T11N), Range Nine West (R9W) of the 6th <br />P.M., in Hall County, Nebraska, more particularly <br />described as follows: Beginning at the intersection of <br />the South right-of-way line of West Anna Street and the <br />East right-of-way line of South Eddy Street; thence <br />Northeasterly along and upon the South line of West <br />Anna Street, a distance of One Hundred Ninety-eight and <br />Six Tenths (198.6) feet;thence Southeasterly along and <br />upon a line One Hundred Ninety-eight and six Tenths <br />(198.6) feet Easterly and parallel to the East line of <br />South Eddy Street, a distance of One Hundred Forty <br />(140.0) feet; thence Southwesterly along and upon a <br />line One Hundred Forty (140.0) feet Southerly and <br />parallel to the South line of West Anna Street, a <br />distance of One Hundred Ninety-eight and Six Tenths <br />(198.6) feet; to a point on the East line of South Eddy <br />Street; thence Northwesterly along and upon the East <br />line of South Eddy Street, a distance of One Hundred <br />Forty (140.0) feet, to the place of beginning. <br /> <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and <br />agreed that the Licensee may construct, maintain, repair and <br />utilize the above described improvement at the Licensee's sole <br />risk. The Licensee hereby waives any claim for damages against <br />the City, its officers, employees, agents and independant <br />contractors for any damage or injury that may result to said <br />improvement.
