<br />88_ 100024 <br /> <br />r <br /> <br />kind and nature whatsoever now or hereafter attached or affixed to <br />the Improvements or the Land or used primarily, from time to time, <br />in connection with the use and enjoyment of the Premises or the <br />maintenance or preservation thereof (collectively, the "Personal <br />Property" ) ; <br /> <br />E. The Mort~lagor's estate, right, title and <br />interest in all subleases of space, licenses, occupancy or conces- <br />sion agreements (collectively, "Leases"; each, a "Lease") granted <br />by Mortgagor now existing or hereafter entered into relating to <br />the Land or the Improvements and any and all amendments,. modifica- <br />tions, supplements and rene'dals of Leases, whether now in effect <br />or hereafter coming into effect, including, without limitation, <br />all rents, additional rents, cash or securities deposited thereun- <br />der to secure performance of the sublessee's obligations thereun- <br />der, revenues, earnings, profits and income, advance rental <br />payments, payments incident to assignment, sublease or surrender <br />of a Lease, claims for forfeited deposits and claims for damages, <br />now due or hereafter to become due, with respect to any Lease; and <br /> <br />F. The r-1ortgagor I s share of all proceeds of the <br />conversion, voluntary or involuntary, of any of the foregoing into <br />cash or liquidated claims inc~uding, without limitation, proceeds <br />of insurance and condemnation a'dards v!i th respect thereto, includ- <br />ing interest thereon and any and all awards or payments and <br />interest thereon; <br /> <br />Mortgagor does hereby bind itself and its successors and <br />assigns to WARRANT AND FOREVER DEFEND the leasehold estate in the <br />Mortgaged Property on behalf of the Trustee and on behalf of his <br />respective successors and assigns against any and every person <br />lawfully claiming all or any part or interest in the Mortgaged <br />Property. <br /> <br />Provided, however, that if Mortgagor shall cause to be <br />paid in full all amounts secured by this Deed of Trust and faith- <br />fully perform all other covenants and agreements under the Loan <br />Agreement, the Beneficiary shall direct the Trustee to reconvey to <br />gaged Property at the sole cost of the Mortgagor. <br /> <br />~ Q ~ ~ ~ ~ ~ ! ~: <br /> <br />Mortgagor hereby covenants and agrees as follows: <br /> <br />ARTICLE I <br /> <br />WARRANTIES, REPRESENTATIONS AND <br />COVENANTS OF MORTGAGOR <br /> <br />SECTION 1.1 Payment of Loan.
