The provisions of this Section 1.7 or any <br />action taken by Beneficiary pursuant to the provisions of this <br />Section 1. 7 shall not prevent any such failure to observe any <br />covenant contained in thi s Deed of Trust from constituting an <br />Event of Default (as hereinafter defined). <br /> <br />r <br />~ <br /> <br />SECTION 1.8 Inspection. !l10rtgagor shall permit Benefi- <br />ciary, by its agents, accountants or attorneys, upon reasonable <br />advance notice, written or oral, except in cases of emergency, to <br />visit and inspect the Premises at such reasonable times as may be <br />requested by Beneficiary. <br /> <br />SECTION 1.9 Mortgagor to Maintain Improvements. Mort- <br />gagor shall not commit any waste on the Premises or make any <br />change in the use of the Improvements or Personal Property or use <br />any of the Land for purposes not related to the current use of the <br />Premises without Beneficiary's prior written consent. Mortgagor <br />shall, at all times, maintain the Premises in good operating <br />order, condi ti on and repai l' . Except as otherwi se provided in <br />Section 1.14, the Premises shall not be demolished or altered, nor <br />shall any Personal Property be removed without the prior written <br />consent of Beneficiary, except to the extent permitted in the Loan <br />Agreement. <br /> <br />Leases. <br /> <br />SECTION 1.10 Mortgagor's Obligations With Respect to <br /> <br />1.10.1 Mortgager shall not without the Beneficia- <br />ry's prior written consent (i) execute any assignment of its <br />interest in the Underlying Lease or any Lease or of the rents or <br />any part thereof from the Premises other than the assignment <br />herein to Beneficiary, (ii) except where the sublessee under any <br />Lease is in default thereunder, terminate or consent to the <br />cancellation or surrender of such Lease, or terminate or consent <br />to cancel the Underlying Lease, (iii) modify any Lease having an <br />unexpired term of two (2) years or more so as to change the <br />unexpired term thereof or so as to decrease the amount of the <br />rents payable thereunder, (iv) accept any prepayments of any <br />installment of rents to become due under any Lease for a period <br />exceeding one month, (v) permit the deferral of or waive or <br />postpone the payment of any rental payment under any Lease, (vi) <br />permit any transfer or assignment of any Lease or the sublease of <br />the property subject to any Lease without the written consent of <br />Beneficiary (except the Beneficiary's prior written consent shall <br />not be required in such instances where the Mortgagor as lessee <br />therein shall not be released), (vii) modify any Lease in any <br />fashion which will impair the value of the Mortgaged Property or <br />the security provided by this Deed of Trust. <br /> <br />1.10.2 Mortgagor shall at all times timely and <br />fai thful1y perform, or cause to be performed, all of the cove- <br />nants, conditions and agreements contained in all Leases and the <br />Underlying Lease to be kept and performed by the Mortgagor there- <br />under and shall at all times do all things necessary to compel <br /> <br />-12- <br /> <br />r--- <br /> <br />L <br /> <br />L <br /> <br />-.J <br /> <br />~, <br /> <br />L, <br />
