<br />TRUST DEED <br /> <br />88_100018 <br /> <br />I <br /> <br />THIS TRUST DEED, made this 30fh day of December, 1987, by <br />and among ELLIOT SUPPLY, INC., a Nebraska corporation, successor <br />in interest to CAPITOL SUPPLY COMPANY, a Nebraska corporation, <br />hereinafter referred to as the "Trustor"; YALE RICHARDS, Attorney <br />at Law, whose mailing address is 6910 Pacific Street, Suite 300, <br />Omaha, Nebraska, 68106, hereinafter referred to as the "Trustee"; <br />and ALBERT M. NEPOMNICK and BERNARD ALTSULER, hereinafter <br />referred to collectively as the "Beneficiary". <br /> <br />WIT N E SSE T H <br /> <br />Trustor, in consideration of the <br /> <br />recited, and the trust herein created, <br /> <br />convey to Trustee, in trust, with power <br /> <br />described real property, to-wit: <br /> <br />A part of the Northeast Quarter of the Northeast <br />Quarter of Section 21, Township 11 North, Range 9, <br />West of the 6th P.M., in Hall County, Nebraska, more <br />particularly described as follows: <br /> <br />indebtedness herein <br />irrevocably grant and <br />of sale, the following <br /> <br />Beginning at the Southwest corner of the <br />intersection of Anna and Eddy ~treets, which <br />streets are now established and 1n use, thence <br />Southwesterly along the Southerly boundary of <br />Anna Street, a distance of 164.2 feet (recorded <br />as 164.4 feet); thence Southeasterly, parallel <br />with the Westerly boundary of Eddy Street, a <br />distance of 140.0 feet; thence Northeasterly, <br />parallel with the Southerly boundary of Anna <br />Street, a distance of 164.2 feet (recorded as <br />164.4 feet), to a point on the Westerly boundary <br />of Eddy Street; thence Northwesterly along and <br />upon the Westerly boundary of Eddy Street, a <br />distance of 140.0 feet, to the point of <br />beginning; and <br /> <br />the Southerly 119.9 <br />South Park Addition <br />surveyed, platted <br />Nebraska. <br /> <br />feet of Lots 9 and 10, in Block 3, <br />to the City of Grand Island, as <br />and recorded in Hall County, <br /> <br />Together with all of the improvements now or hereafter <br />erected on the above-described real property, and all easements, <br />interests in adjoining roads, streets and alleys, rights, <br />appurtenances, rents (subject, however, to the rights and <br />authorities given herein to Beneficiary to collect and apply <br />such rents), and all fixtures now or hereafter attached to the <br />real property, all of which, including replacements and addi- <br />tions thereto, shall be deemed to be and remain a part of the <br />real property covered by this Trust Deed; and all of the fore- <br />going, together with the above-described real property, are <br />herein referred to as the "Property". <br /> <br />r--- <br /> <br />L <br /> <br />To secure to Beneficiary the repayment of the indebtedness <br />evidenced by Trustor's two Promissory Notes, of even date <br />herewith, herein referred to as the "Notes", in the principal <br />sum of One Million Dollars ($1,000,000.00) and Three Hundred <br />Seventy-Five Thousand and No/IOO Dollars ($375,000.00) respec- <br /> <br />I <br />~ <br />~ <br />J <br />~ <br />
