<br />100017 <br /> <br />88-= <br /> <br />I <br /> <br />ACKNOWLEDGMENT <br /> <br />~~ <br /> <br />Pursuant to the provisions of Section 76-1005, R.R.S. <br />Nebraska, 1943, as amended, and before executing the Trust Deed <br />hereinafter described, the undersigned, ELLIOT SUPPLY, INC., a <br />Nebraska corporation, successor in interest to CAPITOL SUPPLY <br />COMPANY, a Nebraska corporation, hereby acknowledges to ALBERT <br />M. NEPOMNICK and BERNARD ALTSULER, collectively referred to as <br />the "Beneficiary" in the Trust Deed hereinafter described, as <br />follows: <br /> <br />1. That the undersigned is <br />and deliver a certain Trust Deed <br />cribed real property: <br /> <br />about to execute, acknowledge <br />conveying the following des- <br /> <br />A part of the Northeast Quarter of the Northeast <br />Quarter of Section 21, Township 11 North, Range 9, <br />West of the 6th P.M., in Hall County, Nebraska, more <br />particularly described as follows: <br /> <br />Beginning at the Southwest corner of the inter- <br />section of Anna and Eddy Streets, which streets <br />are now established and in use, thence Southwest- <br />erly along the Southerly boundary of Anna Street, <br />a distance of 164.2 feet (recorded as 164.4 <br />feet); thence Southeasterly, parallel with the <br />Westerly boundary of Eddy Street, a distance of <br />140.0 feet; thence Northeasterly, parallel with <br />the Southerly boundary of Anna Street, a distance <br />of 164.2 feet (recorded as 164.4 feet), to a <br />point on the Westerly boundary of Eddy Street; <br />thence Northwesterly along and upon the Westerly <br />boundary of Eddy Street, a distance of 140.0 <br />feet, to the point of beginning; and <br /> <br />the Southerly 119.9 feet of Lots 9 and 10, in Block 3, <br />South Park Addition to the City of Grand Island, as <br />surveyed, platted and recorded in Hall County, Nebraska. <br /> <br />together with all buildings, fixtures, improvements and appurte- <br /> <br />nances thereunto belonging, which Trust Deed is being given to <br /> <br />secure two (2) Promissory Notes of even date herewith from the <br /> <br />undersigned to the Beneficiary. <br /> <br />2. That the undersigned understands that the document it <br />is about to execute is a Trust Deed, and not a real estate <br />mortgage, and that said Trust Deed contains a power of sale. <br /> <br />r-- <br /> <br />L <br /> <br />3.
