<br />AFFIDAVIT REGARDING TRUST

<br />Merleen J. Johnson, Trustee, being first duly sworn upon his or her oath, deposes and says:
<br />
<br />1. That the Affiant is the successor trustee under the terms and conditions of the Robert
<br />1. Johnson Revocable Trust dated December 28, 1995, under the terms and conditions of which is
<br />created the Robert 1. Johnson Trust "A" (hereinafter referred to as the "said Trust").
<br />
<br />2. That on September 28, 2006, the Affiant became the successor trustee of the said
<br />Trust following the death of Robert J. Johnson, also known as Robert James Johnson, on August 26,
<br />2006, the settlor and initial trustee of said Trust, a certified copy of his death certificate is attached
<br />as Exhibit "A", and upon signing an Appointment ofa Trustee of the Robert 1. Johnson Revocable
<br />Trust dated December 28, 1995, and Acceptance of Trustee to Act under the Robert 1. Johnson
<br />Revocable Trust dated December 28, 1995, an original of which is attached as Exhibit "B".
<br />
<br />3. That the Affiant remains the sole trustee of the said Trust as of this date.
<br />
<br />4. That among the assets of the said Trust is the following described real property that
<br />was conveyed in trust on December 28, 1995, by Warranty Deed recorded as Document No. 96-
<br />100047 in the records of the Hall County Register of Deeds Office:
<br />
<br />An undivided one-half (Vi) interest in and to Lot Ten (10) in Block Twenty-
<br />Eight (28) in Packer & Barr's Second Addition to the City of Grand Island, Hall
<br />County, Nebraska;
<br />
<br />An undivided one-half (Vi) interest in and to Lot Six (6), in Block Nineteen (19),
<br />of Packer & Barr's Second (2nd) Addition to the City of Grand Island, Hall
<br />County, Nebraska;
<br />
<br />An undivided one-half(Vi) interest in and to Lot Seven (7), Block Seventy-seven
<br />(77), Wheeler and Bennett's Third Addition to the City of Grand Island, Hall
<br />County, Nebraska;
<br />
<br />An undivided one-half (Vi) interest in and to Lot One Hundred Sixty One (161)
<br />in Belmont, an Addition to the City of Grand Island, Hall County, Nebraska;
<br />
<br />An undivided one-half (Yz) interest in and to Lot one (1) in Block fifteen (15) in
<br />Ashton Place, and addition to the City of Grand Island, Hall County, Nebraska;
<br />
<br />An undivided one-half (Yz) interest in and to the East Thirty- Three Feet (E33')
<br />of Lot Six (6), and the West Twenty-Six Feet (W26') of Lot Seven (7), in Block
<br />Fourteen (14), Kernohan and Decker Addition to the City of Grand Island, Hall
<br />County, Nebraska;
<br />
<br />An undivided one-half (Yz) interest in and to the Westerly Forty-four (44) Feet
<br />of Lot Four (4) in Block Fifty-one (51) of Packer & Barr's Second Addition to
<br />the City of Grand Island, Hall County, Nebraska;
<br />
<br />An undivided one-half(Vi) interest in and to Lot Seven (7), Block Ten (10) in the
<br />Original Town, now City of Grand Island, Hall County, Nebraska; and
<br />
<br />An undivided one-half (Vi) interest in and to Lot eight (8) and the East Forty
<br />(40) feet of Lot Seven (7), in Block Fourteen (14) in Kernohan and Decker's
<br />Addition to the City of Grand Island, Hall County, Nebraska.

<br />5, That pursuant to the terms ofthe said Trust and 930-388] (2) of the Nebraska Uniform
<br />Trust Act, the trustee of the said Trust has the power, without court authorization, to acquire or sell
<br />property, for cash or on credit, at public or private sale.
