<br />Section 4 (3) (a) <br /> <br />87-107296 <br /> <br />PREFACE TO TRUST DEED UNDER <br /> <br />r <br /> <br />FARM HOMESTEAD PROTECTION ACT <br /> <br />(NO BUILDINGS LOCATED ON THE REAL ESTATE) <br />Alvin D., Jr., Randall L., & Patricia Kowalski d/b/a <br />The undersigned, Kowalski Brothers OInRx <br />~s~x.~~i~~ prior to signing the attached Trust Deed dated <br />December 22 , 1987, as Trustors, in consideration of the <br />extension of credit by The Fi ve Points Bank, <br />Grand Island , Nebraska, Beneficiary of the attached Trust Deed, <br />hereby state: <br /> <br />1. That there are no buildings sufficient to cause or to be <br />designated as a homestead presently located upon the real estate <br />described in the attached Trust Deed. <br /> <br />2. That the undersigned understand and acknowledge that they have <br />a right to make a designation of homestead in the Trust Deed <br />for the purpose of affording themselves the opportunity to designate <br />their homestead in the event of default and foreclosure upon such <br />Trust Deed. <br /> <br />3. The undersigned further acknowledge that while the Trust Deed <br />remains unsatisfied and a lien on said real estate, they shall have no <br />right to make a designation of homestead thereon, or likewise in the <br />event of foreclosure or trustee's sale upon the attached Trust Deed. <br /> <br />4. The undersigned state that this acknowledgment is their vol- <br />untary act and deed and constitutes a written disclaimer and acknow'- <br />ledgment under the Farm Homestead Protection Act and a waiver of rights <br />to designate his or her homestead in the event of default upon such <br />Trust Deed. <br /> <br />5.
