<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That, Whereas, in an action in the District Court of the
<br />Eleventh Judicial District of the State of Nebraska, within and
<br />for said County of Hall, being Case No. 93-009 wherein The
<br />Equitable Building and Loan Association of Grand Island,
<br />Nebraska, a corporation, is Plaintiff, and craig L. Klingenberg
<br />and Peggy S. Klingenberg, husband and wife; et al. are
<br />Defendants, at the October 14, 1987, of said Court, The Equitable
<br />Building and Loan Association of Grand Island, Nebraska did
<br />obtain a Decree finding that there is due from Craig L.
<br />Klingenberg and peggy S. Klingenberg to The Equitable Building
<br />and Loan Association of the sum of Fifty-Seven Thousand Nine
<br />Hundred Fifty-Nine Dollars and Sixty-Four Cents ($57,959.64) and
<br />whereas, it was then and there further ordered in said action
<br />that in default of the payment of the sum so found due by the
<br />said Craig L. Klingenberg and Peggy S. Klingenberg, that the
<br />Sheriff of said County of Hall, or some other person authorized
<br />by the Court, should caUse the lands and tenements hereinafter
<br />described to be advertised and sold according to law, to pay the
<br />same, and whereas, default having been made therein James H.
<br />Truell was appointed Master commissioner on October 14, 1987, to
<br />sell the real estate under and by virtue of the said Decree and
<br />the Order of Sale to him duly directed, and he did on the 4th day
<br />of December, 1987, in the lower lobby of the Hall County
<br />Courthouse, in Grand Island, Hall County, Nebraska, having first
<br />given due and legal notice of the time and place of said sale by
<br />publication once in each week for four successive weeks in
<br />The Grand Island Daily Independent, a newspaper printed and in
<br />general circulation in said County of Hall, sell said premises at
<br />public auction to The Equitable Building and Loan Association of
<br />Grand Island, Nebraska, a corporation for the sum of Fifty-Four
<br />Thousand Four Hundred Dollars ($54,400.00), which sale was
<br />afterward by said Court, examined and confirmed, and the said
<br />James H. Truell, as such Master Commissioner, ordered to convey
<br />the said premises in fee simple to the said Equitable Building
<br />and Loan Association of Grand Island, Nebraska, a corporation.
<br />
<br />Lot Sixteen (16), in LeHeights Fourth Subdivision, Hall
<br />County, Nebraska.

<br />NOW, THEREFORE, I, the said James H. Truell, Master
<br />Commissioner, as aforesaid, in consideration of the premises and
<br />by virtue of the powers vested in me by law and the Decree of
<br />said Court, do hereby Give, Grant, and Convey to the said The
<br />Equitable Building and Loan Association of Grand Island,
<br />Nebraska, a corporation, the premises so as aforesaid sold, to-
<br />wit:
<br />
<br />TO HAVE AND TO HOLD the same unto the said The Equitable
<br />Building and Loan Association of Grand Island, Nebraska, its
<br />successors and assigns, and to it and its use and behoof forever.

<br />appeared the said James H. Truell, Master Commissioner, to me

<br />foregoing instrument as grantor, and he acknowledged the same to
<br />be his voluntary act and deed, as such Master commissioner, for
<br />the uses and purposes therein set forth.
