87-107263 r- ACKNOWLEDGEMENT The undersigned, McDennott and Miller, P.C., identified as "Trustor" under a certain Deed of Trust Construction Security Agreement dated Decenber 21, 1987 in respect to that real estate described as: Lot One (1), in Woodridge South Subdivision, Grand Island, Hall County, Nebraska, and interest in a perpetual ea.c:;anent for parking, ingress and egress on the West 126 ft. of Lot Two (2), Woodridge South Subdivision, City of GrHJld Island, Hall County, Nebraska, to be entered into aroong Trustor; Arend R. Baack, Attorney at Law, "Trustor"; and The Overland National Bank of Grand Island, Beneficiary, hereby acknowledges that this Acknowledganent is made prior to its execution of that Deed of Trust Construction Security Agreement and that it knows and understands that (a) the Deed of Trust Construction Security Agreement to be executed by 'l'rustor is a Trust Deed and not a Mortgage and (b) that the power of sale provided for in the Deed of Trust Construction Security Agreement provides essentially different. rights and obligations to the Trustor than a Mortgage in the event of default or breach of obligation.
