The Federal Land Bank of Omaha is the owner and holder of certain <br />real estate mortgages in Hall County, Nebraska; and <br /> <br />WHEREAS, AT&T Communications of the Midwest, Inc. is planning to install a <br />new lightguide fiber optics cable system to upgrade and enhance its <br />nationwide long distance network; and <br /> <br />WHEREAS, the owners of real estate which are affected by the above~described <br />improvement have granted certain easements to the said AT&T Communications of <br />the Midwest. Inc., which are recorded in the real estate records of said <br />county; and <br /> <br /> <br />WHEREAS, a portion of said real estate is encumbered by real estate mortgages <br />in favor of The Federal Land Bank of Omaha, said mortgages are identified in <br />Exhibit "A," which is attached hereto and made a part hereof by reference; <br />and <br /> <br />WHEREAS, The Federal Land Bank of Omaha desires to subordinate any interest <br />it may have by reason of said mortgage liens to the right of AT&T <br />Communications of the Midwest. Inc. to construct. operate, maintain, replace <br />and remove such communication systems as may from time to time be required. <br />consisting of underground cables. lightguides, wires. conduits, manholes, <br />drains, splicing boxes, repeaters, repeater housings. together with surface <br />testing-terminals, markers. and other appurtenances, upon, over and under the <br />real estate described in said mortgages. <br /> <br />NOW THEREFORE. in consideration of the granting of said easements by owners <br />of said premises and the payment of the sum of one dollar ($1.00) and other <br />good and valuable consideration, The Federal Land Bank of Omaha declares that <br />the lien of the mortgages described in Exhibit "A" are inferior and <br />subordinate to the easements granted by the record owners to the said AT&T <br />Communications of the Midwest.
