<br />r <br /> <br />87-107170 <br /> <br /> <br />MASTER COMMISSIONER'S DEED <br /> <br />KNOW ALL MEN BY THESE PRESENTS, That, Whereas, In an action in the <br />District Court of the Eleventh Judicial District of the State of Nebraska, <br />within and for the County of Hall, wherein Walter E. Smith and YuvettaL. <br />Smith, Husband and Wife, were Plaintiffs, and Randy L. Krotz and Margaret <br />Krotz Pickrel were Defendants; afid Whereas, Walter E. Smith and Yuvetta L. <br />Smith, Husband and Wife, did obtain a decree finding that there ,is due from <br />Randy L. Krotz and Margaret Krotz Pickrel, to Walter E. Smith and Yuvetta L. <br />Smith, Husband and Wife, the sum of Twelve Thousand, Five Hundred. Eighty-Four <br />Dollars and Forty Cents ($12,584.40), and whereas, it was then and there <br />further ordered in said action that in default of payment of the sum so found <br />due by the said Randy L. Krotz and Margaret Krotz Pickrel, that the Court, <br />pursuant to Amended Section 25-2144 of the Revised Statutes of the State of <br />Nebraska, did on or about O~tober 16. 1987 appoint John <br />Cunningham Master Commissioner and order him to cause the lands and tenements <br />hereinafter described to be advertised and sold according to law to pay the <br />same, and, whereas, default having been made therein, the said John <br />Cunningham, Master Commissioner, under and by virtue of said decree, and order <br />of sale to him duly directed, did on the 19th day of November, 1987, at the <br />lower lobby of the Courthouse in the City of Grand Island and said County of <br />Hall, having first given due and legal notice of the time and place of said <br />sale by said publication once in each week for four successive weeks in the <br />Grand Island Daily Independent, a newspaper printed and in general circulation <br />in said County of Hall, sell said premises at public auction to Walter E. <br />Smith and Yuvetta L. Smith, Husband and Wife, for the sum of Ten Thousand <br />Dollars ($10,000.00), which sale was afterward, examined and confirmed by said <br />Court and the said John Cunningham, ordered to convey the premises in fee <br />simple to Walter E. Smith and Yuvetta L. Smith, Husband and Wife. <br />NOW, THEREFORE, John Cunningham, Master Commissioner, in <br />consideration of the premises and by virtue of the powers vested in me and the <br />decree of said Court, do hereby give, grant and convey to Walter E. Smith and <br />Yuvetta L. Smith, Husband and Wife, their heirs and assigns, the premises so <br />as foresold, to-wit: <br />The Southerly Ninety-one (91) feet of Lot Eight (8), <br />Block One Hundred Thirty-eight (138), Union Pacific <br />Railway Companies Second Addition to the City of Grand <br />Island, Hall County, Nebraska, known as 402 West 8th <br />Street, Grand Island, Hall County, Nebraska. <br />TO HAVE AND TO HOLD THE SAME unto the said Walter E. Smith and <br />Yuvetta L.
