<br />ROBERT K. POLAND and JUDITH K. POLAND, Husband and Wife, herein called
<br />Grantors, in consideration of One Dollar ($1.00) receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the
<br />

<br />CITY OF GRAND ISLAND, NEBRASKA,

<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />overhead electrical utility lines, poles, anchors, terminals, transformers,
<br />cables, conductors, surface markers, and other appurtenances connected
<br />therewith, in, upon, above, along, across, over, and through a sixteen (16.0)
<br />foot wide easement tract located in part of Lot Three (3), Island, Section
<br />Twenty Three (23), Township Eleven (11) North, Range Nine (9) West of the 6th
<br />P.M" Hall County, Nebraska; the centerline of the easement tract being more
<br />part~cularly described as follows:

<br />Commencing at the Southwest corner of said Section Twenty
<br />Three (23), Township Eleven (11) North, Range Nine (9)
<br />West; thence Easterly along the South line of said Section
<br />Twenty Three (23), a distance of one thousand five hundred
<br />sixty seven and sixty-hundredths (1,567,60) feet; thence
<br />deflecting left 90000'00" and running Northerly, a
<br />distance of one thousand three hundred ten and thirty-
<br />eight hundredths (1,310.38) feet, to the ACTUAL point of
<br />beginning; thence deflecting left 79055'58" and running
<br />Northwesterly, a distance of one hundred thirty six and
<br />seventy-seven hundredths (136.77) feet; thence deflecting
<br />right 117019'00" and running Northeasterly, a distance of
<br />one thousand eighty five (1,085.0) feet.

<br />The above said easement containing 0.449 acres more or
<br />less, as shown on the plat dated 11/23/87, marked Exhibit
<br />"A", attached hereto, and incorporated herein by
<br />reference,
<br />
<br />together with the following rights:
<br />
<br />Unrestricted ingress and egress to the above described easement tract for
<br />
<br />the installation, maintenance, operation, and removal of such overhead
<br />
<br />electrical utility lines and appurtenances.

<br />Such rights of ingress and egress shall include all rights necessary for
<br />
<br />
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />
<br />
<br />granted, including but not limited to the right to place electrical line
<br />
<br />
<br />anchors, or anchors with guy wires attached thereto, on Grantors' property; to
<br />
<br />
<br />remove, clear, and keep clear trees, bushes, hedges, undergrowth, and other
<br />
<br />obstructions interfering with the surveying, construction, inspection,
<br />
<br />
<br />maintenance, repair, replacement, extension, removal, or operation of such
<br />
<br />overhead electrical utility lines and appurtenances, No structures, buildings,
<br />
<br />fences, or other obstructions of any kind whatsoever, shall be allowed in,
<br />
<br />upon, above, along, across, over, or through the easement herein granted.

<br />The parties hereto agree that the Grantors may continue to use the
<br />easement area herein granted for any other use permitted by law, that does not
<br />interfere with the oper9tion and maintenance of the overhead electrical utility
<br />lines and appurtenances constructed therein,
