<br />AT&T COMMUNICATIONS OF THE MIDWEST, INC., an Iowa corporation, herein

<br />called Grantor, in consideration of

<br />One Dollar ($1.00)

<br />, receipt of which
<br />

<br />is hereby acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />underground electrical utility lines, cables, terminals, transformers, surface
<br />'markers, and other appurtenances connected therewith, in, upon, above, along,
<br />across, underneath, and through a sixteen (16.0) foot wide easement across a
<br />tract of land located in part of the Northwest Quarter of the Southwest Quarter
<br />(NW-l/4,SW-1/4) of Section Four (4), Township Eleven (11) North, Range Nine (9)
<br />West of the 6th P.M., in Grand Island, Hall County, Nebraska; the centerline of
<br />the 'easement being more particularly described as follows:
<br />
<br />Beginning at a point on the North right-of-way line of
<br />Roberts Street, said point being three hundred fifty eight
<br />and seven-tenths (358.7) feet West of the East line of said
<br />Northwest Quarter of the Southwest Quarter (NW-l/4,SW-1/4);
<br />thence Northerly parallel to the East line of said Northwest
<br />Quarter of the Southwest Quarter (NW-l/4,SW-l/4), a distance
<br />of ninety (90.0) feet; thence deflecting left 90023'42", and
<br />running Westerly a distance of one hundred and thirty five
<br />(135.0) feet.

<br />Said easement containing 0.081 acres more or less, as shown
<br />on the plat dated 10/5/87, marked Exhibit "A", attached
<br />hereto, and incorporated herein by reference,
<br />
<br />together with the following rights:
<br />
<br />Unrestricted ingre3s and egress to the above described easelllent tract for
<br />
<br />
<br />the installation, maintenance, operation, and removal of such underground
<br />
<br />electrical utility lines and appurtenances.
<br />
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />granted, including the right to remove, clear, and keep clear trees, bushes,
<br />hedges, undergrowth, and other obstructions interfering with the surveying,
<br />construction, inspection, maintenance, repair, replacement, extension, removal,
<br />or operation of such underground, electrical utility lines and appurtenances,
<br />No improvements, structures, buildings, fer-ces, or other obstructions of any
<br />kind whatsoever, shall be allowed in, upon, above, along, across, underneath,
<br />or through the easement herein granted.

<br />All underground electrical utility lines, cables, terminals, transformers,
<br />surface markers, and other appurtenances connected therewith, placed in, upon,
<br />above, along, across, underneath, and through such easement shall remain the
<br />property of the Grantee; and may be removed or replaced at any time,
<br />
<br />The Grantor for itself, its heirs, successors, and assigns, hereby
<br />covenants that the rights and privileges herein granted shall run with the
<br />title to such tract of land; and shall be binding upon the Grantor, its heirs,
<br />successors, and assigns.
