Except as specifically modified by this Loan Modifica- tion Agreement, all other terms and provisions of the Note dated Novanber 21 f1984, previously executed by the Borrowers shall remain in full force and effect. 3. The. Note dated NovA11hp.r 21 , 19 84, hereby modified is presently secured by a Deed of Trust dated November 21 , 19 84, and recorded as Document No. 84-006212 in the office of the Register of Deeds of Hall County, Nebraska, in respect to that real estate described as: Part of Lots Fifteen (15) and Sixteen (16), in Block Three (3), in Fifth Addition to the trnvn of Cairo, Hall Countv. Nebraska described as beginning at a point 80 feet east of the Northwest corner of Lot Sixteen (16) in said Block Three (3), thence runnin~ East 60 feet thence runnin~ south 85 feet: thence running west 60 feet: thence TIlnning north 8Q fp.p.t to the nlace of beginning. and, in accordance w~th the provisions of that Deed of Trust, it shall remain as security for the indebtedness hereby modified. 4. All real estate mortgages, deeds of trust, assignments and security agreements heretofore granted by Borrowers to the Lender shall remain in full force and effect and shall in no manner be affected by this Loan Modification Agreement and shall continue as security for the indebtedness modified by this Agreement, as well as any future indebtedness owing from Borrowers to the Lender for future "a'~ances and renewals in respect to all sums owing from Borrowers to the Lender. 5. Borrowers further covenant to and with the Lender that they shall, and will, at any time, now or later, upon request, make, do, execute and deliver all such further and other acts, deeds and things as shall be reasonably required to effectuate the intention of this Loan Modification Agreement and to insure and confirm to the Lender all and singular the property, securi- ties and rights described, and intended to be conveyed as security, so as to render the same, and all portions, whether now owned, or later acquired, subject to these terms, provisions and conditions according to the true intent and purposes expressed. 6. The failure of the Lender, at any time, to require the performance by the Borrowers of any of these terms, covenants and agreements shall, in no way, affect its rights to enforce the same; nor the waiver by the Lender of any breach of any term, covenant or agreement be taken or held to be a waiver of any succeeding breach or any such term, covenant or agreement, or as a waiver of the term, covenant and Agreement itself. -2- L L r- LJ --.J t
