<br />That TRUSTOR hereby 9rants, bargains, s811s, conveys and warranL.s to
<br />TRUSTEE, IN TRUST, his heirs, devisees, personal representatives, successors
<br />arid assigns, with power of sale, the following-described reOll property:

<br />LOTS ONE (1) AND TWO (2), BLOCK ONE (1) PLEASANT HILL ADDITION
<br />TO CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />
<br />together with all improvements and appurtenances thereon.
<br />
<br />The TRUSTOR hereby covenants and agrees with the TRUSTEE and
<br />BENEFICIARIES that he is lawfully seized Olnd the owner of the above-described
<br />property; that he hOlS good right and lawful authority to sell and convey said
<br />premises and that said premises are free and clear of all liens and
<br />encumbrances, EXCEPT a Deed of Trust given by BENEFICIARIES, Richard L.
<br />Berggren Olnd Barbara A. Berggren, husband and wife, in favor of First State
<br />Bank, 119 C Street, Shelton, Nebraska, as Trustee and Beneficiary, recorded
<br />,July 7, 2006, as Document No. 0200606100, which Deed of Trust will be paid in
<br />full prior to TRUSTOR's final payment due hereunder on or before February )0,
<br />)008, and further, that TRUSTOR w,iJI warrant and defend the title to sa i d
<br />premises forever against the claims of all persons whomsoever.

<br />For the purpose of securing performance of each agn:ement of TRUSTOR
<br />herein contained and the payment of STX THOUSAND fIVE HUNDRED DOLLARS
<br />($6,500.00), the TRUSTOI'.. has executed a Trust De,,-'d Note bearing even date, at
<br />the rate of interest and on the terms and conditions as set forth in such Trust
<br />Deed Note until paid. The principal sum and interest shall be payable in
<br />accordance with and upon the terms and conditions of said Trust Deed Note of
<br />even da L.e. All payments due hereunder- shall be paid at the address of the
<br />BENEFICIARIES as above described, or at such other place as such BENEFICIARIES
<br />or the holders of said security shall desi9nate in writing. All instal1rnenl~
<br />payments hereunder shall be applied first to the payment of inLerest on Uw
<br />unpaid balance, pursuant to the Amort'i.zal~ion Schedule, a copy of which has been
<br />provided to each of the parties hereto, and the remainder of each payment of
<br />such installment to be applied on principal.

<br />It is agreed by and between the parties hereto that while title IS vested
<br />in the TRUSTEE and until filing of Notice of Default, the TRUSTOR shall:

<br />A. Retain possc>ssion of the property at all times, except as may be
<br />otherwise a9reed by the parties in writing.

<br />R. Maintain the re:o;idence and any other improvements located on the
<br />real property in 900d condition and repair.
<br />
<br />C. Pay all general and special taxes and all special assessments of
<br />every ki nd levied or a:o;sessed against or due upon said property
<br />before delinquency, and to deliver to BENEFICIARIES copies of
