Lindquist, a <br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", <br />pursuant to a power of sale contained in that certain Deed of Trust recorded on June 18, 2002 as <br />Instrument No. 0200206491 in the office of the Register of Deeds of Hall County, Nebraska, and <br />the Secretary of the Department of Housing and Urban Development, hereinafter called <br />"Grantee." <br /> <br />WHEREAS, on May 15, 2006, Grantor, executed a Notice of Default pursuant to which <br />notice was given to Joshua L. Cole, Trustor, under that certain Deed of Trust recorded on June 18, <br />2002 as Instrument No. 0200206491 in the office of the Register of Deeds of Hall County, <br />Nebraska, covering that certain premises described as: <br /> <br />THE NORTHERL Y 42 FEET OF THE EASTERL Y 6 FEET OF <br />FRACTIONAL LOT 8 AND THE NORTHERL Y 42 FEET OF FRACTIONAL <br />LOT 9 ALL IN FRACTIONAL BLOCK 4 OF RUSSEL WHEELER'S <br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA, <br /> <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting <br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy <br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of <br />Hall County, Nebraska, on May 17,2006, as Instrument No. 0200604318. <br /> <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska. <br /> <br />Subsequent thereto, beginning on October 6, 2006, Grantor caused to be published in The <br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a <br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the <br />described property would be sold at public auction to the highest bidder for cash or certified or <br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand <br />Island, Hall County, Nebraska at 10:00 a.m. on November 16,2006. Publication of such notice was <br />made for five consecutive weeks on October 6,2006, October 13,2006, October 20,2006, October <br />27,2006 and November 3,2006, the last publication being at least ten (10) days but not more than <br />thirty (30) days prior to the date of sale. <br /> <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties <br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008 <br />R.R.S. Nebraska. <br /> <br />Pursuant to said Notice of Tmstee's Sale, John B. McDermott, attorney for Grantor, did at <br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public <br />auction, and did sell the same to Chase Home Finance LLC for the sum of $45,977.83, it being the <br />highest bidder therefor.
