<br />200700713 <br /> <br />3. Borrowers' Continuing Liability. The Borrowers agree that Borrowers' present <br />liability under the Deed of Trust Note shall not be impaired, prejudiced or affected in any way <br />whatsoever by this agreement, or by the assumption of Assuming Party of said loan, or by any <br />subsequent change in the terms, time, manner or method of payment of said indebtedness or any <br />part thereof contracted by the Lender and the Assuming Party or the transferees of the Assuming <br />Party, whether or not such changes or such transfers have been consented to by the Borrowers. <br /> <br />4. Continuing Effect. Except as modified hereby, the Deed of Trust Note, Deed of Trust <br />and Right of First Refusal shall remain in full force and effect, and the undersigned Assuming <br />Party promises to pay said indebtedness as herein stated and to perform all ofthe obligations of <br />said instruments. <br /> <br />5. Binding Effect. This assumption by the Assuming Party shall bind on Assuming Party <br />and its legal representatives, successors and assigns. <br /> <br />IN WITNESS WHEREOF, the parties have hereunto executed this Loan Assumption <br />Agreement on the date first noted above.
