<br />;-.. <br /> <br />-., <br />'.. <br /> <br />20070028:L <br /> <br />AMENDMENT TO DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS <br />AND CONDITIONS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION <br />HOMEOWNERS' ASSOCIATION AND SUMMERFIELD ESTATES FIFTH AND SIXTH <br />SUBDIVISIONS HOMEOWNERS' ASSOCIATION" <br /> <br />THIS AMENDMENT is made this /ftl.. day of f).y ('...,..1..,. ....., 2006, by the undersigned, <br />("hereinafter referred to as "Owners") for themselves and for their successors, grantees and <br />assIgns. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, a Declaration of Restrictive Covenants, Restrictions and Conditions for <br />Summerfield Estates First Subdivision Homeowners' Association ("hereinafter referred to as <br />"First Subdivision Declaration") was filed in the Office of the Register of Deeds of Hall County, <br />Nebraska on April 27, 2000 as Instrument No. 0200003417, which Declaration was recorded <br />against the following described real estate, to-wit: <br /> <br />Lots One (1) through Six (6), Block Three (3) and Lots One (1) through Eight (8), <br />Block Four (4), all in Summerfield Estates First Subdivision in the City of Grand <br />Island, Hall County, Nebraska, a tract ofland comprising a part ofthe West Half <br />ofthe Southwest Quarter (W~SWY4) of Section Twelve (12), Township Eleven <br />(11) North, Range Ten (10) West of the 6th P.M., in Hall County, Nebraska, all as <br />surveyed and platted and is more particularly described as recorded in the office <br />of the Register of Deeds of Hall County, Nebraska (hereinafter referred to as "the <br />First Subdivision"); and <br /> <br />WHEREAS, a Declaration of Restrictive Covenants, Restrictions and Conditions for <br />Summerfield Estates Fifth and Sixth Subdivisions Homeowners' Association ("hereinafter <br />referred to as "Fifth and Sixth Subdivisions Declaration") was filed in the Office ofthe Register <br />of Deeds of Hall County, Nebraska on September 6,2006 as Instrument No. 0200607966, which <br />Declaration was recorded against the following described real estate, to-wit: <br /> <br />Lots One (1) through Six (6), Block One (1) and Lots Five (5) through Eight (8), <br />Block Two (2), all in Summerfield Estates Fifth Subdivision in the City of Grand <br />Island, Hall County, Nebraska, and Lots One (1) through Four (4), all in <br />Summerfield Estates Sixth Subdivision in the City of Grand Island, Hall County, <br />Nebraska, (a replat of Lots One (1) through Four (4), Block Two (2) in <br />Summerfield Estates Fifth Subdivision in the City of Grand Island, Hall County, <br />Nebraska (hereinafter referred to as "the Fifth and Sixth Subdivisions"); and <br /> <br />WHEREAS, Paragraph 9. of the First Subdivision Declaration provides that the First <br />Subdivision Declaration may be amended by an instrument signed by the owners of the lots in <br />the First Subdivision; and <br /> <br />WHEREAS, Paragraph 9. of the Fifth and Sixth Subdivisions Declaration provides that <br />the Fifth and Sixth Subdivisions Declaration may be amended by an instrument signed by the <br />owners ofthe lots in the Fifth and Sixth Subdivisions; and <br />
