<br />200700035 <br /> <br />Section 6.1 Pavment Obligations. <br /> <br />Grantor fails to pay any of the Obligations when due, whether on the scheduled due date or upon <br />acceleration, maturity or otherwise. <br /> <br />Section 6.2 Transfers. <br /> <br />Grantor Transfers, or contracts to Transfer, all or any part of the Property or any legal or <br />beneficial interest therein (except for Transfers of the Accessories expressly permitted under this Deed of <br />Trust). <br /> <br />Section 6.3 Other Obligations. <br /> <br />Grantor fails to promptly perform or comply with any of the Obligations set forth in this Deed of <br />Trust (other than those expressly described in other Sections of this Article VI). <br /> <br />Section 6.4 Event of Default Under Other Loan Documents. <br /> <br />An Event of Default (as defmed therein) occurs under the Note or the Loan Agreement, or <br />Borrower fails to promptly pay, perform, observe or comply with any obligation or agreement contained <br />in any of the other Loan Documents (within any applicable grace or cure period). <br /> <br />Section 6.5 Change in Zoninl! or Public Restriction. <br /> <br />Any change in any zoning ordinance or regulation or any other public restriction is enacted, <br />adopted or implemented that limits or defines the uses which may be made of the Property such that the <br />present or intended use of the Property, as specified in the Loan Documents, would be in violation of such <br />zoning ordinance or regulation or public restriction, as changed. <br /> <br />Section 6.6 <br /> <br />Default Under Leases. <br /> <br />Grantor fails duly to perform its obligations under any Lease, and such failure is not cured within <br />the grace period, if any, provided in the Leases. <br /> <br />Section 6.7 Default Under Other Lien Documents. <br /> <br />A default occurs under any other mortgage, deed of trust or security agreement covering the <br />Property, including any Permitted Encumbrances. <br /> <br />Section 6.8 Execution: Attachment. <br /> <br />Any execution or attachment is levied against any of the Property, and such execution or <br />attachment is not set aside, discharged or stayed within thirty (30) days after the same is levied. <br /> <br />Article VII <br />Ri!!hts and Remedies. <br /> <br />Upon the happening of any Event of Default, Lender, or Trustee at the direction of Lender, shall <br />have the right, in addition to any other rights or remedies available to Lender under any of the Loan <br />Documents or applicable Law, to exercise anyone or more of the following rights, powers or remedies: <br /> <br />Section 7.1 Acceleration. <br /> <br />Lender may accelerate all Obligations under the Loan Documents whereupon such Obligations <br />shall become immediately due and payable, without notice of default, notice of acceleration or intention <br />to accelerate, presentment or demand for payment, protest, notice of protest, notice of nonpayment or <br />dishonor, or notices or demands of any kind or character (all of which are hereby waived by Grantor). <br /> <br />Hall County, Nebraska <br />Error!
