<br />WAYNE D. STOLTENBERG and MARY V. STOLTENBERG, husband and wife and
<br />DONALD E. STOLTENBERG and R. MARIE STOLTENBERG, husband and wife,
<br />GRANTORS, in consideration of FIFTY THOUSAND AND NO/IOO DOLLARS ($50,000.00)
<br />received from GRANTEES, RANDY R. EICKHOFF and LISA A. EICKHOFF, husband and
<br />wife, convey to GRANTEES, as joint tenants with rights of survivorship and not as tenants in
<br />common, the following described real estate (as defined in Neb. Rev. Stat. ,9 76-201) situated in
<br />Hall County, Nebraska:

<br />Lots One (1) and Two (2), Stoltenberg Acres Subdivision, Hall County,
<br />Nebraska.
<br />
<br />subject to the following restrictions:
<br />
<br />(a) No building or dwelling house shall be moved onto said lots and
<br />placed upon said lots. No pre-fab, modular or mobile home shall be placed
<br />on said lots.
<br />
<br />(b) All construction and building on said lots shall be so performed
<br />that it will comply with the requirements of the building codes and ordinances
<br />of Hall County, Nebraska and the City of Grand Island, Nebraska, as applicable.
<br />
<br />(c) Any structure placed or constructed upon said lots shall be completed
<br />within twelve (12) months after the commencement of construction.
<br />
<br />(d) No worn out, inoperable, unlicensed or discarded automobiles,
<br />machinery, or parts thereof: shall be stored on said lots and no portion thereof
<br />shall be used for automobiles, junk piles, or the storage of any kind or discarded
<br />items or waste material.
<br />
<br />All of the afore-referenced conditions and restrictions shall run with the land and shall be
<br />binding upon all persons and all parties claiming ownership of said lots; subject to enforcement
<br />by, through or under the Grantors or their successors in interest.
<br />
<br />GRANTORS covenant Gointly and severally, if more than one) with GRANTEES that
<br />GRANTORS:
<br />
<br />(1) are lawfully seized of such real estate and that it is free from encumbrances;
<br />except easements, reservations, covenants and restrictions of record;
<br />
<br />(2) have legal power and lawful authority to convey the same; and
<br />
<br />(3) warrant and will defend title to the real estate against the lawful claims of all
<br />persons.
