<br />TRUSTEE'S DEED
<br />
<br />This instrument, made this 3 day of November, 2006, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on April 30, 2003 as
<br />Instrument No. 0200305359 in the office of the Register of Deeds of Hall County, Nebraska, and
<br />the Secretary of the Department of Housing and Urban Development, hereinafter called
<br />"Grantee."
<br />
<br />WHEREAS, on July 31, 2006, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Prudencio Bautista Pablo and Santa Mendoza Bautista, husband and wife,
<br />TrJ.stors, under that certain Deed of Trust recorded on April 30, 2003 as Instrument No.
<br />0200305359 in the office ofthe Register of Deeds of Hall County, Nebraska, covering that
<br />certain premises described as:
<br />
<br />Lot Eight (8), in Block Ten (10), in Joehnck's Addition to the City of Grand
<br />Island, Hall COlmty, Nebraska,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on August 15,2006, as Instrument No. 0200607258.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on September 16, 2006, Grantor caused to be published in
<br />The Grand Island Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description ofthe property to be sold and
<br />stating that the described property would be sold at public auction to the highest bidder for cash
<br />or certified or cashier's check, at the lower level lobby of the Hall County Courthouse, 1st &
<br />Locust Street, Grand Island, Hall County, Nebraska at 2:00 p.m. on November 1, 2006.
<br />Publication of such notice was made for five consecutive weeks on September 16, 2006,
<br />September 23,2006, September 30, 2006, October 7, 2006 and October 14,2006, the last
<br />publication being at least ten (10) days but not more than thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />R.R.S. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at
<br />public auction, and did sell the same to Grantee for the sum of $87,507.94, it being the highest
<br />bidder therefor.
<br />
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $87,507.94 so
<br />bie! and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its
<br />successors and assigns forever, all the estate, right, title and interest of which the said Prudencio
<br />Bautista Pablo and Santa Mendoza Bautista, husband and wife, and their successors in interest,
