<br />HOMESTEAD DESIGNATION DISCLAIMER
<br />
<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act, Neb. Rev.
<br />Stat. Sections 76-1901, et seq., as a preface to the execution, and as a part of the following Deed of
<br />Trust, the undersigned Trustor being first duly sworn, elect to Disclaim the Right to Designate a
<br />Homestead.
<br />
<br />We disclaim the right to designate a homestead on the property described in the following Deed
<br />of Trust. No part of our homestead is presently, or in the future will be, situated upon said real estate.
<br />We understand that if we establish a homestead on any part of the real estate during the time the Deed
<br />of Trust remains unsatisfied and a lien on the real estate, we shall have no right to make a designation
<br />of homestead in the event of a Trustee's sale or a foreclosure sale

<br />THIS DEED OF TRUST is made as of the In day of 4-~~~ ' 2006, by
<br />MICHAEL PATRICK HANNON and KIMBERLY S. HANNON husband and wife, jointly and
<br />severally, ("TRUSTOR"), whether one or more, whose mailing address is: 7207 S. Bluff Center
<br />Road, Shelton, Nebraska 68876;

<br />and, DUANE A. BURNS, Attorney, ("TRUSTEE"), whose mailing address is: 308 N. Locust
<br />Street, Suite #306, Grand Island, Nebraska 68801;

<br />and GEORGE E. FRAZELL, ("BENEFICIARY") whether one or more, whose mailing address
<br />is 7312 N. 190th Road, Shelton, Nebraska 68876-9610.

<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br />Beneficiary, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in Hall County, Nebraska, and legally described as follows: (the "property"):

<br />The South Half of the Northeast Quarter (S1/2NE1/4) of Section
<br />Nineteen (19), Township Ten (10) North, Range Twelve (12),
<br />West of the 6th P.M. in Hall County, Nebraska, containing
<br />approximately 80 acres.
<br />
<br />TOGETHER WITH all rents, easements, tiPpurtenances, llcreditaments, interests in adjoining
<br />roads situated thereon.
<br />
<br />The property and the entire estate and interest conveyed to the Trustee are referred to
<br />collectively as the "Trust Estate".
<br />
<br />FOR THE PURPOSE OF SECURING:
<br />
<br />a. Payment of indebtedness in the total principal amount of $170,000.00, with interest thereon
<br />at the rate of 7.0% per annum, as evidenced by that certain Promissory Note of even date (the
<br />"Note") with a maturity date of December 1,2018 which by this reference is hereby made a part
<br />hereof, and any and all modifications, extensions and renewals thereof, and,
