McIntosh, a single person, and Galen Sears, a single person ("McIntosh/Sears") ("-"? ---,:-- ~, ~ b RECITALS: WHEREAS, Williams own the property legally described as: The Northerly 65.5 Feet of Lot Five (5) in Fractional Block One Hundred Four (104), in Koenig and Wiebe's Addition to the City of Grand Island, Hall County, Nebraska, ("Williams Property"); and WHEREAS, McIntosh/Sears own the property legally described as: The Southerly ~. 5 Feet of Lot Five (5) in Fractional Block One Hundred Four (104), in Koenig and Wiebe's Addition to the City of Grand Island, Hall County, Nebraska, ("McIntosh/Sears Property"); and WHEREAS, the predecessors of Williams and McIntosh/Sears entered into a Two-Party Garage Agreement which was filed on January 22, 1980, in the Register of Deeds Office as Document No. 80-000323 ("the Agreement"); and WHEREAS, the parties desire to enter into this Release. NOW, THEREFORE, IT IS AGREED by and between the parties as follows: 1. The Agreement is hereby terminated and released and is of no further force or effect, effective immediately upon full execution of this Release of Two-Party Garage Agreement.
