<br />This instrument, made this 10th day of November, 2C06, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on March 25, 1994 as
<br />Instrument No. 94-102416 in the office of the Register of Deeds of Hall County, Nebraska, and
<br />Five Points Bank, hereinafter called "Grantee."
<br />
<br />WHEREAS, on June 19, 2006, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Julie A. Garcia and Gilbert J. Garcia, wife and husband, Trustors, under that
<br />certain Deed of Trust recorded on March 25, 1994 as Instrument No. 94-102416 of Hall County,
<br />Nebraska, covering that certain premises described as:
<br />
<br />THE NORTHERLY SIXTY SIX (66) FEET OF LOT ONE (1) IN BLOCK
<br />FIVE (5) IN WINDOLPH'S ADDITION TO THE CITY OF GRAND
<br />ISLAND, HALL COUNTY, NEBRASKA,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfY
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on June 21,2006, as Instrument No. 0200605553.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska.
<br />
<br />Subsequent thereto, beginning on September 23, 2006, Grantor caused to be published in
<br />The Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska,
<br />a Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street,
<br />Grand Island, Hall County, Nebraska at 2:00 p.m. on November 9, 2006. Publication of such notice
<br />was made for five consecutive weeks on September 23, 2006, September 30, 2006, October 7,2006,
<br />October 14, 2006 and October 21, 2006, the last publication being at least ten (10) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />RR.S. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />tlle time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to Grantee for the sum of $41,000.00, it being the highest bidder
<br />therefor.
<br />
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $41,000.00 so bid
<br />and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and
<br />assigns forever, all the estate, right, title and interest of which the said Julie A. Garcia and Gilbert J.
<br />Garcia, wife and husband, and their successors in interest, were seized or possessed at the time said
<br />Deed of Trust was given, or at any time thereafter, in and to the premises sold as aforesaid, to-wit:
