<br />DEED OF TRUST MODIFICATION AGREEMENT

<br />I il.ft! THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this
<br />~day of NOVEMBER. 2006, by and between ROBERT D KUTZ AND MARLA M
<br />KUTZ. HUSBAND AND WIFE, hereinafter referred to as "Borrower", and HOME FEDERAL
<br />SA VINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred to as
<br />"lender",
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, Borrower did execute a certain Adjustable Rate Note payable to the order of
<br />the Lender in the total original amount of SIXTY FOUR THOUSAND AND NOII00 , Dollars
<br />($64.000.00);
<br />
<br />WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable
<br />Rate Rider dated OCTOBER 13. 1983, filed of record in the Office of the HALL COUNTY
<br />REGISTER OF DEED'S OFFICE. HALL COUNTY. NE on OCTOBER 14. 1983 in
<br />DOCUMENT # 83-005515 in respect to that real estate described as:
<br />
<br />LOT TWO (2), AND LOT FOUR (4), IN BLOCK TEN (10), IN UNIVERSITY PLACE, AN
<br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />
<br />WHEREAS, Borrower has requested that interest be converted to a fixed rate rather than the
<br />variable rate specified by such Deed of Trust with Adjustable Rate Rider and that the stated
<br />maturity date be also hereby modified;
<br />
<br />WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to
<br />be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity
<br />date;
<br />
<br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust
<br />with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the
<br />presently remaining indebtedness from and after the date hereinafter specified together with a
<br />fixed rate of interest rather than a variable rate as originally set forth in such Adjustable Rate
<br />Rider;
<br />
<br />NOW, THEREFORE, it is agreed:
<br />
<br />1. Interest Rate and Maturity Modification. Commencing effective DECEMBER 1.
<br />2006. the indebtedness secured by the Deed of Trust with Adjustable Rate Rider hereinabove
<br />identified shall accrue interest at a fixed rate of SEVEN percent (7.000%) throughout the
<br />remaining term of such indebtedness and, notwithstanding the provisions contained in the
<br />Adjustable Rate Rider, there shall be no further adjustments to such interest rate. The final
<br />maturity of such indebtedness as modified, secured by such Deed of Trust shall be NOVEMBER
<br />1. 2013, notwithstanding any other date of maturity which may have been specified in the Deed
<br />of Trust hereinabove identified.
