This Space Reserved for Register of Deeds. <br /> <br />LICENSE AGREEMENT <br /> <br />This License Agreement is made by and between the CITY OF GRAND ISLAND, <br />NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and FLATW A TER <br />APP AREL, INC., a Nebraska corporation, hereinafter referred to as the "Licensee." <br /> <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set <br />fOlill the tenns and conditions under which the Licensee may construct, maintain, repair, and <br />utilize the following described improvement which will infringe upon right-of-way held by the <br />Licensor: <br /> <br />Installation, maintenance, and repair of three historic light posts to be installed in <br />the City's right-of-way between the sidewalk and the street near 307-311 W. 41h in <br />Grand Island, Nebraska, as shown on the attached drawing. The face of such posts <br />must be located at least two feet six inches (2'6") from the face of the street curb <br />and at least one (1.0) foot from the edge of the sidewalk. <br /> <br />? DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the <br />following described real estate adjacent to the Licensor's right-of-way to which this License <br />Agreement shall apply: <br /> <br />Lots One (1) and Two (2), Block Forty (40), Original Town, now City of Grand <br />Island, Hall County, Nebraska <br /> <br />3. LICENSEE'S DlTITES AND RISKS. It is understood and agreed that the <br />Ijcensee lnay construct, maintain, repair and utilize the above described improvement at the <br />Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its <br />officers, employees, agents and independent contractors for any damage or injury that may result <br />to said improvement.
