<br />\ <br /> <br />200609534 <br /> <br />IV. The Mallard Haven Property shall be principally utilized as a <br />hunting lodge by the shareholders of Mallard Haven and their <br />invited guests. Mallard Haven shall not utilize the Mallard Haven <br />Property for any commercial purposes whatsoever, including <br />commercial hunting excursions. <br /> <br />v. The Mallard Haven Property shall never be developed or utilized <br />as a permanent residential property. Casual, limited, periodic <br />overnight stays are acceptable. <br /> <br />VI. The Mallard Haven Property shall not be utilized for large parties, <br />assemblies or other congregation of individuals, but shall primarily <br />be used for personal recreation and sporting activities of the <br />shareholders of Mallard Haven, their limited guests and invitees. <br /> <br />vii. No outdoor speakers, amplification systems, or other sound <br />systems shall be used or maintained on the Mallard Haven <br />Property. Any tape player, radio, wireless, or other music or <br />entertainment delivery system shall be operated at such levels as <br />cannot be heard at the residence and homestead situated on the <br />Thorn Property. <br /> <br />V111. Mallard Haven's use of the Mallard Haven Property shall not <br />otherwise interfere with Thoms' quiet, peaceful, private use and <br />enjoyment of the Thorn Property. Thoms acknowledge that the <br />Mallard Haven Property is and will be utilized for waterfowl, <br />upland game and dove hunting in season, blue rock shooting and <br />four-wheeler operations and similar hunting and recreation <br />activities in a reasonable and timely manner. <br /> <br />3. In the event Mallard Haven violates any of the terms and conditions of this license <br />agreement, Thoms shall have the following rights: <br /> <br />A. If Thoms believe, in Thoms' reasonable, but presumptively correct <br />discretion, that there has been a violation of any conditions of this license <br />agreement, Thoms shall give written notice to Mallard Haven of such <br />violation. Mallard Haven shall thereafter remedy such violation and cease <br />and desist from future violation of the same condition. <br /> <br />B. In the event Mallard Haven fails to cure such violation or thereafter again <br />breaches such condition, Thoms shall give a second written notice of such <br />violation. <br /> <br />C. After the second written notice from Thoms, upon any future breach or <br />violation of such condition, Thoms shall have the right to interrupt and <br />terminate electric service over, along and across the service line located on <br />and under the Thorn Property until such time as Thoms, in Thoms' <br /> <br />Page 3 of6 <br />
