TROM and JANIS M. TROM, husband and wife, <br />(hereinafter "Thoms") are the owners of Government Lot One (1) (Mainland) in Section Four <br />(4), Township Nine (9) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, also <br />known as the Northeast Quarter of the Northeast Quarter (NE/4 NE/4) and the South Half of the <br />Northeast Quarter (S/2 NE/4) of Section Four (4), Township Nine (9) North, Range Ten (10) <br />West of the 6th P.M., Hall County, Nebraska (hereinafter referred to as the "Thorn Property"); <br />and <br /> <br />WHEREAS, PLATTE RIVER MALLARD RAVEN, INC., a Nebraska <br />Corporation, (hereinafter "Mallard Haven") is the owner of Lot One (1) Mainland, Section <br />Thirty-three (33), Township Ten (10) North, Range Ten (10) West of the 6th P.M., and all <br />accretion land thereto, in Hall County, Nebraska (hereinafter referred to as the "Mallard Haven <br />Property"); and <br /> <br />WHEREAS, Mallard Haven desires to obtain electric service to the Mallard Haven <br />Property, which service requires the installation of an underground electric supply line under and <br />across the Thorn Property; and <br /> <br />WHEREAS, Thoms are willing to grant Mallard Haven a revocable license to place the <br />electric supply line across the northerly portion of the Government Lot One (1) of the Thorn <br />Property; and <br /> <br />WHEREAS, Thoms and Mallard Haven desire to enter into a license agreement creating <br />the rights and obligations of the parties to this Agreement; <br /> <br />NOW, THEREFORE, in consideration of the premises and other good and valuable <br />consideration, Thoms and Mallard Haven agree as follows: <br /> <br />1. Thoms hereby grant to Mallard Haven a revocable license to construct, lay, own, <br />use, operate, inspect, maintain, repair, replace and remove an underground <br />electric supply line under and across a portion of the Thorn Property to supply <br />electric service exclusively to the Mallard Haven Property, which electric supply <br />line shal I be installed underground within and across the current access road <br />serving the Mallard Haven Property existing over the northern portion of <br />Government Lot One (1). <br /> <br />Page 1 of6 <br />
