<br />FIRST AMENDMENT TO DEED OF TRUST
<br />
<br />This First Amendment to Deed of Trust (hereinafter referred to sometimes as
<br />"Amendment") made and entered into effective as of this 1f!:day of (J~ ,2006, from
<br />Copper Creek Estates Grand Island, LLC, a Nebraska limited liability company, (hereinafter referred
<br />to as "Trustor"); Five Points Bank, (hereinafter referred to as "Trustee"), whose address is North
<br />Branch, 2015 North Broadwell, Grand Island, NE 68803; and Five Points Bank (hereinafter referred
<br />to as "Beneficiary"), whose address is PO Box 1507, Grand Island, NE 68802-1507.

<br />Recitals:
<br />
<br />WHEREAS, Trustor has granted to Trustee, in trust, for the benefit of Beneficiary,
<br />that certain Deed of Trust dated August 2,2006, and recorded in the official records ofthe Register
<br />of Deeds of Hall County, Nebraska, on August 3,2006, as Instrument No. 2006-06901 (the "Original
<br />Deed of Trust"); and
<br />
<br />WHEREAS, Trustor and Beneficiary wish to amend the Original Deed of Trust to
<br />clarify and correct the legal description contained therein;
<br />
<br />WHEREAS, Trustee is executing this Amendment to signify it consent, if any be
<br />required, for the effectiveness of this Amendment.
<br />
<br />WITNESSETH:
<br />
<br />NOW, THEREFORE, for and in consideration of the premises, the sum of$10.00
<br />and other good and valuable consideration, the receipt and sufficiency of which is hereby
<br />acknowledged, Trustor and Beneficiary hereby agree as follows:
<br />
<br />1. The legal description as described in the Original Deed of Trust is hereby
<br />amended to read as follows:
<br />
<br />See attached Exhibit "A".
<br />
<br />2. Except as specifically provided herein, the Original Deed of Trust as amended
<br />by this Amendment shall be and remains in full force and effect and not modified or further amended
<br />or changed hereby.
<br />
<br />IN WITNESS WHEREOF, Trustor has executed, sealed, and delivered this First
<br />Amendment to Deed of Trust effective as of the day, month, and year first above written.
