<br />THAT, WHEREAS, in an action in the District Court of Hall County, Nebraska, wherein
<br />Bank of New York, Trustee under the Pooling and Servicing Agreement Series 1998-1, by and
<br />through its loan servicing agent, hldyMac Bank, is the Plaintiff, and Douglas D. Wales, a single
<br />person, et aI., are the Defendants, Bank of New York, TIUstee under the Pooling and Servicing
<br />Agreement Series 1998-1, by and through its loan servicing agent, IndyMac Bank, did obtain a
<br />Decree finding that there is due from Douglas D. Wales to Bank of New York, Trustee under the
<br />Pooling and Servicing Agreement Series 1998-1, by and through its loan servicing agent, IndyMac
<br />Bank, the sum of Forty-Five Thousand Three Hundred Three and 19/1 00 Dollars $45,303.19 plus
<br />interest and costs of suit; and
<br />
<br />WHEREAS, it is further ordered in said Decree that in default of the payment of the sum so
<br />found due by the said Defendant, Douglas D. Wales that the Hall County Sheriff, should cause the
<br />lands and tenements hereinafter described to be advertised and sold according to law to pay the
<br />same; and
<br />
<br />WHEREAS, default having been made therein, the said Hall County Sheriff, under and by
<br />virtue of the said Decree and the Order of Sale to him duly directed, did on July 24, 2006 at the Hall
<br />County Courthouse in the City of Grand Island, in said County of Hall, having first given due and
<br />legal notice of the time and place of said sale by publication once in each week for four consecutive
<br />'.veeks in a newspaper printed and in general circulation in said County of Hall, sell said premises at
<br />public auction to the Plaintiff, Bank of New York, Trustee under the Pooling aud Servicing
<br />Agreement Series 1998-1 for the sum of Forty-Seven Thousand Four Hundred Ninety.Seven
<br />and 15/100 Dollars ($47,497.15). The sale was afterward on August 23, 2006. examined and
<br />confirmed and the Hall County Sheriff, ordered to convey said premises in fee simple title to Bank
<br />of New York, Trustee under the Pooling and Servicing Agreement Series 1998-1, its successors and
<br />assigns, purchaser at sale.

<br />Sheriff, in the County of Hall County, State of Nebraska, as aforesaid, in consideration of the
<br />premises and by virtue of the powers vested in me by law and the Decree of said Court, do hereby
<br />give, grant and convey to Bank of New York, Trustee under the Pooling and Servicing Agreement
<br />Series 1998-1, its successors and assigns, the premises as aforesaid sold, to-wit:

<br />Lot 4, Block 1, Dale Roush 2nd Subdivision, City of Grand Island, Hall County, Nebraska
<br />together with all improvements now or hereafter erected on the Property and all easements,
<br />appurtenances, fixtures now or hereafter a part of the Property and the appurtenances thereto.
<br />
<br />TO HAVE AND TO HOLD the same unto Bank of New York, Trustee under the Pooling
<br />and Servicing Agreement Series 1998-1, its successors and assigns, and to them and their use and
<br />behoof forever.
