<br />AMENDED DECLARATION OF RESTRICTIVE COVENANTS
<br />
<br />THIS AMENDED DECLARATION OF RESTRICTIVE COVENANTS, is made
<br />effective as of this ~ day of ~70t16K ,2006, by and between ANDREW W. MEIER, a
<br />single person, and STEVEN D. OSLE and JUDY L. BOSLE, Husband and Wife, hereinafter
<br />referred to as "Declarants", for themselves, their heirs, successors, grantees and assigns.

<br />WITNESSETH:
<br />
<br />WHEREAS, Declarants are all of the owners of the following described real estate:
<br />Lots One (1) and Two (2), all in Amick Acres West Fourth Subdivision, Hall
<br />County, Nebraska,
<br />
<br />hereinafter referred to at the "Real Estate";
<br />
<br />WHEREAS, the Real Estate has heretofore been subject to the covenants, restrictions and
<br />conditions contained in a Declaration of Restrictive Covenants, Restrictions and Conditions for
<br />Townhouse Homeowners Association of Amick Acres West dated and recorded on August 31,
<br />2004 as Instrument Number 200408683 in the office of the Hall County Register of Deeds;
<br />
<br />WHEREAS, the Declarants do hereby state that they and their predecessors in title to the
<br />Real Estate have not utilized Townhouse Owners Association of Amick Acres West Incorporated
<br />in any manner to carry out the provisions for control, maintenance or upkeep of the Real Estate;
<br />
<br />WHEREAS, the Declarants do hereby vacate the Declaration of Restrictive Covenants,
<br />Restrictions and Conditions for Townhouse Homeowners Association of Amick Acres West
<br />previously recorded and agree that upon the recording of this Amended Declaration of
<br />Restrictive Covenants, it shall be void and of no further force or effect; and
<br />
<br />WHEREAS, from and after the date of the recording of this Amended Declaration of
<br />Restrictive Covenants, the Real Estate shall be subject only to the restrictions, covenants and
<br />conditions herein expressed,
<br />
<br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
<br />I.
<br />TERMINATION OF EXISTING COVENANT
<br />
<br />Effective upon the recording ofthis Amended Declaration of Restrictive Covenants, the
<br />Declaration of Restrictive Covenants, Restrictions and Conditions for Townhouse Homeowners
<br />Association of Amick Acres West dated and recorded August 31, 2004 as Instrument Number
<br />200408683 are no further force or effect.
<br />
<br />II.
<br />IMPOSITION OF RESTRICTIVE PROVISIONS
<br />
<br />Oeclarants hereby declare that the Real Estate described above, shall be held, sold and
<br />conveyed subject to the following reservations, easements, limitations, restrictions, servitudes,
<br />covenants, conditions, charges and liens, (hereinafter collectively termed "covenants and
<br />conditions"). Such covenants and conditions are for the purpose of protecting the value and
<br />desirability of said lots, shall run with the Real Estate, shall be binding upon all parties having
<br />any right, title or interest in the Real Estate and shall inure to the benefit of each owner thereof
<br />
<br />III.
<br />DESCRIPTION OF LAND
<br />
<br />The lands of the Declarants which are hereby submitted to this Amended Declaration of
<br />Restrictive Covenants are a fee simple interest in Lots One (1) and Two (2), all in Amick Acres
<br />West Fourth Subdivision, Hall County, Nebraska, all as surveyed and platted and is more
