Deed of Trust or the Trustee's and the Beneficiary's security interest in the Trust Property in any <br />way, the Beneficiary may, from time to time, regardless of consideration and without notice to or <br />consent by the holder of any subordinate Lien, right, title or interest in or to the Trust Property, <br />(a) release any Persons liable for the Obligations; (b) extend the maturity of, increase or <br />otherwise alter any of the terms of the Obligations; (c) modify the interest rate payable on the <br />principal balance of the Obligations; (d) release or reconvey, or cause to be released or <br />reconveyed all or any portion of the Trust Property; or (e) take or release any other or additional <br />security for the Obligations. <br />6.22 Rules of Usage. The following rules of usage shall apply to this Deed of Trust <br />unless otherwise required by the context: <br />1. Singular words shall connote the plural as well as the singular, and vice <br />versa, as may be appropriate. <br />2. The words "herein ", "hereof' and "hereunder" and words of similar <br />import appearing in this Deed of Trust shall be construed to refer to such document as a <br />whole and not to any particular section, paragraph or other subpart thereof unless <br />expressly so stated. <br />3. References to any Person shall include such Person and its successors and <br />permitted assigns. <br />4. Each of the parties hereto and their counsel have reviewed and revised, or <br />requested revisions to, this Deed of Trust, and the usual rule of construction that any <br />ambiguities are to be resolved against the drafting party shall be inapplicable in the <br />construction and interpretation of such documents and any amendments or exhibits <br />thereto. <br />5. Unless an express provision requires otherwise, each reference to "the <br />Trust Property" shall be deemed a reference to "the Trust Property or any part thereof', <br />and each reference to "Secured Property" shall be deemed a reference to "the Secured <br />Property or any part thereof'. <br />6.23 No Off -Set. All sums payable by the Trustor shall be paid without counterclaim, <br />other compulsory counterclaims, set -off, or deduction and without abatement, suspension, <br />deferment, diminution or reduction, and the Obligations shall in no way be released, discharged <br />or otherwise affected (except as expressly provided herein) by reason of. (a) any damage or any <br />condemnation of the Trust Property or any part thereof, (b) any title defect or encumbrance or <br />any eviction from the Trust Property or any part thereof by title paramount or otherwise; or (c) <br />any bankruptcy, insolvency, reorganization, composition, adjustment, dissolution, liquidation or <br />other like proceeding relating to the Beneficiary or the Trustor, or any action taken with respect <br />to this Deed of Trust by any agent or receiver of the Beneficiary. The Trustor waives, to the <br />extent permitted by law, all rights now or hereafter conferred by statute or otherwise to any <br />abatement, suspension, deferment, diminution or reduction of any of the Obligations. <br />6.24 Consent to Jurisdiction and Service of Process; Waiver of Jpa Trial. <br />21 <br />
