<br />WHEREAS 4Evergreen II, L.L.c., is the owner of Outlot A and Lots One and Two,
<br />Cedar Ridge Second Subdivision, a replat of Lot Three Cedar Ridge First Subdivision in
<br />the City of Grand Island, Hall County, Nebraska;
<br />
<br />AND WHEREAS GILD Investments, L.L.c., is purchasing Lots Three, Four, Five
<br />and Six of Cedar Ridge Second Subdivision, a rcplat of Lot Three Cedar Ridge First
<br />Subdivision in the City of Grand Island, Hall County, Nebraska;
<br />
<br />AND WHEREAS Buffalo Properties, L.L.c., is the owner of Lots One and Two,
<br />Cedar Ridge First Subdivision in the City of Grand Island, Hall County, Nebraska;
<br />
<br />NOW, THEREFORE, 4Evergreen II, L.L.c., GILD Investments, L.L.c., and
<br />Buffalo Properties, L.L.c., hereby agree as follows:
<br />
<br />1. 4Evergreen II, L.L.c., hereby grants and conveys to GILD Investments,
<br />L.L.c. and Buffalo Properties, L.L.c., an easement upon Outlot A, Cedar
<br />Ridge Second Subdivision, a replat of Lot Three Cedar Ridge First
<br />Subdivision in the City of Grand Island, Hall County, Nebraska, for purpose
<br />of ingress and egress to all of the real property described above and for the
<br />construction, maintenance and repair of a street to be located on said Outlot
<br />A. The costs and expenses for the construction, maintenance and repair of
<br />said street shall be shared equally by the parties hereto or their successors or
<br />assigns.
<br />
<br />2. The easement granted herein shall be for the benefit of and appurtenant to
<br />the real property described above and shall run with said land and shall be for
<br />the benefit and use of the owners of the above described real property and
<br />their successors and assigns.
