<br />2006080~1 <br /> <br />(d) "Lot" shall mean and refer to any platted lot of real estate <br />on which North Point condo~ium is situated and shall initially include <br />only Lot One (1), jjl... L ,I.u KAAAR Subdivision to the City of <br />Grand Island, Hall County, Nebraska together with any portion or <br />subsequent resubdivision of that lot. "Lot" shall also mean and refer to <br />any additional platted lot that may be added to increase the number of <br />units or that make it part of a larger condominium in accordance with <br />special declarant rights retained by the Declarant. <br /> <br />3. Each Owner of any unit in North Point Condominium agrees to this <br /> <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND <br /> <br />CONDITIONS FOR NORTH POINT CONDOMINIUMS by acceptance of any <br /> <br />conveyance of a unit in North Point Condominium, or any portion thereof, including <br /> <br />subsequent units created by any amendment to this Declaration whether or not it is so <br /> <br />expressed in any such conveyance. <br /> <br />4. The following standards shall be applicable to all commercial ot1ice <br /> <br />structures constructed within the Properties: <br /> <br />(a) All exterior colors shall be aesthetically pleasing and shall <br />not include any loud, bright or obnoxious color schemes. The change of <br />any exterior color of any office structure shall be approved by the <br />Association in writing. <br /> <br />(b) Exposed foundation walls shall be painted or sided to <br />match the exterior color scheme of the ot1ice structure. <br /> <br />(c) Owner shall comply with all other requirements imposed <br />by the Subdivision Agreement appearing in that instrument recorded as <br />Document No. 200510375 in the office of the Hall County Register of <br />Deeds and applicable regulations imposed by the City of Grand Island, <br />Hall County, Nebraska. <br /> <br />5. The following standards shall be applicable to the construction and <br />installation of improvements other than the commercial office units. <br /> <br />(a) Fencing shall not be constructed upon limited common <br />elements without the prior consent of the Association and such approval <br />may be conditioned upon Owner's payment of all Association expenses <br />attributable to the construction of such fence, including increased <br />operating expenses associated with the construction and maintenance of <br />the fence. <br /> <br />(b) Accessory structures such as storage sheds or detached <br />garages to be constructed upon limited common elements must be first <br />approved by the Architectural Committee of Condominium Owners <br />Association of North Point, Inc. and the Association. <br /> <br />(c) No digital satellite dish larger than twenty inches in <br />diameter shall be permitted and any such permitted satellite dish shall be <br />located and screened so as to be as unobtrusive as is reasonably possible. <br /> <br />(d) Owner shall comply with all other requirements of <br />applicable regulations imposed by the City of Grand Island, Hall County, <br />Nebraska. <br /> <br />6. Any wall constructed on any common line between two adjoining units <br />within the Properties shall be a party wall. Any expense of structural repair, replacement <br /> <br />4 <br />
