<br />200608021 <br /> <br />condominiums or other real estate and the Declarant shall also retain the following <br /> <br />additional special declarant rights: <br /> <br />(a) The Declarant may use any unit owned or leased by the Declarant <br />as a model, sales office or management office. <br /> <br />(b) Appoint or remove any officer of the Condominium Owners <br />Association of North Point, Inc. or any executive board member during any <br />period of declarant control herein provided for. <br /> <br />7. Allocated Interests. The allocated interests have been established based <br /> <br />upon a formula utilizing the number of units in the condominium. Since there initially <br /> <br />are six (6) units comprising the condominium, it is hereby declared that all allocated <br /> <br />interest shall be based upon the number of units, in the following manner: <br /> <br />(a) Voting. Each unit shall be entitled to one (1) vote in the conduct <br />of the condominium through the Condominium Owners Association of North <br />Point, Inc. <br /> <br />(b) Common Expense Liability, Unit One (1) shall be responsible for <br />and shall be assessed for Twenty-Four Percent (24%) of all common expenses <br />incurred by the Condominium Owners Association of North Point, Inc.; Unit Two <br />(2) shall be responsible for and shall be assessed for Eleven Percent (11 %) of all <br />common expenses incurred by the Condominium Owners Association of North <br />Point, Inc.; Unit Thrce (3) shall be responsible for and shall be assessed for Thirty <br />Percent (30%) of all common expenses incurred by the Condominium Owners <br />Association of North Point, Inc.; Unit Four (4) shall be responsible for and shall <br />be assessed for Twelve Percent (12%) of all common expenses incurred by the <br />Condominium Owners Association of North Point, Inc.; Unit Five (5) shall be <br />responsible for and shall be assessed for Twenty-Three Percent (23%) of all <br />common expenses incurred by the Condominium Owners Association of North <br />Point, Inc.; and Unit Six (6) shall not be responsible for and shall not be assessed <br />for any common expenses incurred by the Condominium Owners Association of <br />North Point, Inc. <br /> <br />(c) Fractional Interest in Common Elements. Unit One (1) shall be <br />allocated a Twenty-One Percent (21 %) undivided interest in and to the common <br />elements ofthe condominium; Unit Two (2) shall be allocated a Ten Percent <br />(10%) undivided interest in and to the common elements of the condominium; <br />Unit Three (3) shall be allocated a Twenty-Six Percent (26%) undivided interest <br />in and to the common elements of the condominium; Unit Four (4) shall be <br />allocated a Ten Percent (10%) undivided interest in and to the common elements <br />ofthe condominium; Unit Five (5) shall be allocated a Twenty Percent (20%) <br />undivided interest in and to the common elements of the condominium; and Unit <br />Six (6) shall be allocated a Thirteen Percent (13%) undivided interest in and to the <br />common elements of the condominium. <br /> <br />8. Conveyances. Any unit may be conveyed or encumbered, subject to the <br />provisions of this declaration. <br />9. Association. Condominium Owners Association of North Point, Inc. <br />(association) has been incorporated in Nebraska to provide for the management of the <br />condominium. <br /> <br />10. Membership. Every person or entity who becomes a unit owner shall be a <br />member of the association. Any person who holds an interest in a unit merely as security <br />for any obligation shall not be a member. <br /> <br />2 <br />
