<br />PERMANENT EASEMENT
<br />
<br />JOYCE M. HARDER, Trustee, and DIANN MUHLBACH, Trustee, herein called the
<br />GRANTORS, for ONE DOLLAR ($1.00) AND OTHER VALUABLE CONSIDERATION,
<br />receipt of which is hereby acknowledged, hereby grant and convey unto
<br />VILLAGE OF CAIRO, NEBRASKA, A Municipal Corporation
<br />in Hall County, Nebraska, GRANTEE, a permanent and perpetual easement and right-of-way to
<br />construct, operate, maintain, repair, remove and replace water mains and sanitary sewer mains
<br />and necessary appurtenances and improvements associated with water and sewer lines upon,
<br />above, across, underneath and through the following-described real estate:

<br />A 30 foot wide permanent utility easement located in Lot 1, Lot 2, Lot 4 and
<br />Lot 5 of Harder Estates Subdivision in the Village of Cairo, Hall County,
<br />Nebraska and more particularly described as follows:
<br />
<br />The West 15 feet of Lots 1 and 5 of Said Harder Estates Subdivision and the
<br />East 15 feet of Lots 2 and 4 of said Harder Estates Subdivision. Said
<br />permanent utility easement contain 4,458 square feet or 0.10 acres more
<br />or less of which 0.07 acres are existing permanent utility easement.
<br />
<br />Together with unrestricted ingress and egress, through and across the above-described tract of land
<br />for the purpose of exercising the rights herein granted. The Grantee covenants that it shall pack the
<br />topsoil in the trenches where the utilities are placed and restore the surface ofthe ground as near as
<br />possible to its present condition.
<br />This easement shall be perpetual and shall run with the land and shall be binding upon the parties
<br />hereto and the heirs, devisees, personal representatives and assigns of the Grantors.
