The lands submitted to this DECLARATION OF RESTRICTIVE COVENANTS, <br />RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES FIFTH AND SIXTH <br />SUBDIVISIONS IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA, are <br />Lots One (1) through Six (6), Block One (1) and Lots Five (5) through Eight (8), Block Two (2), <br />all in Summerfield Estates Fifth Subdivision in the City of Grand Island, Hall County, Nebraska, <br />and Lots One (1) through Four (4), all in Summerfield Estates Sixth Subdivision in the City of <br />Grand Island, Hall County, Nebraska, (a replat of Lots One (1) through Four (4), Block Two (2) <br />in Summerfield Estates Fifth Subdivision in the City of Grand Island, Hall County, Nebraska). <br /> <br />III. <br /> <br />RESTRICTIVE COVENANTS. RESTRICTIONS AND CONDITIONS <br /> <br />In consideration of the mutual benefits to be derived by the Owner of Summerfield <br />Estates Fifth and Sixth Subdivisions in the City of Grand Island, Hall County, Nebraska, and any <br />purchaser or purchasers, their heirs, devisees, personal representatives, successors, assigns or <br />grantees, the Owner stipulates and agrees that all lots in Summerfield Estates Fifth and Sixth <br />Subdivisions in the City of Grand Island, Hall County, Nebraska, that are sold, transferred or <br />conveyed, shall be and are subject to the following restrictive covenants, restrictions and <br />conditions. All restrictive covenants, restrictions and conditions shall run with the land and are <br />as follows: <br /> <br />1. All lots in the subdivision shall be known and described as residential lots. <br /> <br />2. All construction and building shall be so performed that it will comply with the <br />requirements ofthe building codes and ordinances of the City of Grand Island, Nebraska. <br /> <br />3. No building or dwelling house shall be moved into said subdivision and placed <br />upon a lot. No pre-fab, modular or mobile home shall be placed on a lot; no trailer, tent, garage, <br />shack or any other unsightly out-building shall be used in said subdivision as a dwelling at any <br />time, nor shall any structure of a temporary nature be used as a residence. <br /> <br />4. No barns, chicken houses, horse trailers, commercial work or sales shops, or other <br />buildings for the care and housing of fowl, rabbits or livestock shall be placed, maintained or <br />used on any lot; nor shall any fowl, rabbits or animals other than household pets be kept upon <br />any lot, and household pets shall not be kept, bred or maintained for any commercial purposes. <br />No noxious or offensive activity shall be permitted on any lot nor shall there be anything done <br />thereon which may become an annoyance or nuisance to the neighborhood. <br /> <br />5. All lots may include townhomes or condominiums and shall be subject to a <br />separate DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND <br />COVENANTS FOR SUMMERFIELD ESTATES FIFTH AND SIXTH SUBDIVISIONS <br /> <br />2 <br />
