Depue, a <br />member of the Nebraska State Bar Association and Successor Trustee <br />pursuant to Appointment of Successor Trustee filed on May 19, 2006, <br />as Instrument No. 200604439, upon a Deed of Trust made and entered <br />into on or about April 29, 2005, by and between Alan J. Sheppard, <br />a single person, Trustor, and Plate Enterprises L.L.C., Benefi- <br />ciary, and Gary Byrne, Attorney at Law, Trustee, which Deed of <br />Trust was filed on May 3, 2005, in the Register of Deeds office of <br />Hall County, Nebraska, as Document No. 200504008, herein called the <br />Grantor, in consideration of Seventy-one Thousand Seven Hundred and <br />NO/100 Dollars ($71,700.00), received from Grantee, does hereby <br />grant, bargain, sell, convey and confirm unto Plate Enterprises <br />L.L.C., herein called the Grantee, the following described real <br />property in Hall County, Nebraska: <br /> <br />Lot One (1), and the Easterly Four (4) Feet of Lot Two <br />(2), in Block Forty-two (42), Russel Wheeler's Addition <br />to the City of Grand Island, Hall County, Nebraska. <br /> <br />TO HAVE AND TO HOLD the above described premises together with <br />all tenements, hereditaments, and appurtenances thereto belonging <br />and to the Grantee. <br /> <br />Grantor does hereby covenant with Grantee as follows: <br /> <br />1. That Alan J. Sheppard, Trustor, failed to pay the <br />Beneficiary payments which were contractually due and the Grantor, <br />at the request of the Beneficiary, elected to declare the entire <br />unpaid principal balance together with interest thereon at once <br />immediately due and payable; <br /> <br />2. That a notice of default was filed by Grantor on June 14, <br />2006, in the Register of Deeds office of Hall County, Nebraska, as <br />Document No. 200605315. A copy of the notice of default was served <br />on Alan J. Sheppard, Trustor, by certified mail, postage prepaid on <br />June 14, 2006; <br /> <br />3. The Trustor, Alan J.
