<br />TRUSTEE'S DEED
<br />
<br />This instrument, made this 14th day of July, 2006, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on March 2, 2001 as Instrument No.
<br />0200101635 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of
<br />the Department of Housing and Urban Development, hereinafter called "Grantee."
<br />
<br />WHEREAS, on April 27, 2006, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Kelly 1. Zapp, a single person, Trustor, under that
<br />certain Deed of Trust recorded on March 2,2001 as Instrument No. 0200101635 in the office ofthe
<br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />
<br />The Southerly Seventy Three (73) feet of Lot Five (5), in Block One Hundred
<br />Forty Two (142) in Union Pacific Railway Company's Second Addition to the
<br />City of Grand Island, Hall County, Nebraska,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on May 2, 2006, as Instrument No. 0200603865.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on June 3, 2006, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 PM on July 13,2006. Publication of such notice was made
<br />for five consecutive weeks on June 3, 2006, June 10,2006, June 17,2006, June 24, 2006 and July 1,
<br />2006, the last publication being at least ten (10) days but not more than thirty (30) days prior to the
<br />date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />R.R.S. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to Wells Fargo Bank, N.A., successor by merger to Wells Fargo
<br />Home Mortgage, Inc. for the sum of $35,213.00, it being the highest bidder therefor. Wells Fargo
<br />Bank, N.A., successor by merger to Wells Fargo Horne Mortgage, Inc. has assigned all of its right,
<br />title and interest in such bid to Grantee.
<br />
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $35,213.00 so bid
<br />and paid as aforesaid, I, Grantor do hereby grant and convey unto said Grantee, its successors and
<br />assigns forever, all the estate, right, title and interest of which the said
