The claiming successors, namely the affiants herein, are entitled to the real <br />property by reason ofthe homestead allowance, exempt property allowance, family <br />allowance and the laws of intestate succession. <br /> <br />11. The affiants which are the claiming successors as defined by law have made <br />an investigation and have not been able to determine any subsequent Will. <br /> <br />12. That there is no other person who has a right to the interest of the Decedent in <br />the described property except the affiants. <br /> <br />13. The affiants as surviving spouse and children of the Decedent are entitled to <br />the property being passed and conveyed to them. <br /> <br />14. That more than ten (10) years have passed since the date of death ofthe <br />Decedent, JACQUELINE G. BOMST AD, and there is no liens for inheritance tax that <br />would be due and owing and that the property can pass to the affiants as successor and <br />interest to JACQUELINE G. BOMST AD free and clear of any inheritance tax liens. <br /> <br />15. That since the date of death ofthe Decedent, ALLEN L. BOMSTAD, has <br />been in possession of the above-referenced real estate and remains in possession as of this <br />date. <br /> <br />16. That it is the intent of the affiants as successor in interest to the interest of the <br />Decedent, JACQUELINE GAY BOMSTAD, in and to the referenced real estate that the <br />property be conveyed by Quitclaim Deed from all the affiants to ALLEN L. BOMST AD. <br /> <br />17. That JACQUELINE G. BOMST AD and JACQUELINE GAY BOMST AD <br />were one in the same person notwithstanding the discrepancy in the use of the middle <br />name and middle initial. <br /> <br />18. That the undersigned affiants who claim as successors under this Affidavit <br />swear and affirm that all statements in this Affidavit are true and material and further <br />acknowledge that any false statement may subject the person or persons to penalties <br />relating to Perjury under Section 28-915, R.~S..
