Leaman <br />and Ralisa E. (the "Subject Real Estate"). <br /> <br />WHEREAS, Borrowers have granted an easement to TLC Properties, LLC covering <br />the Subject Real Es ate, said easement hereinafter referred to as "TLC's Easement", said Easement <br />being recorded on (, 2006, as Instrument No. 2006tJ7J.'L~ of the Hall County, <br />Nebraska real estate re rds; and <br /> <br />WHEREAS, TLC's interest in said Easement should be paramount and superior to <br />the lien of Platte Valley. <br /> <br />NOW, THEREFORE, in consideration of One Dollar ($1.00) and other valuable <br />consideration to Platte Valley, the receipt whereof is hereby acknowledged, Platte Valley does <br />hereby waive the priority of its Deeds of Trusts as described above and agrees that said TLC's <br />Easement shall be superior to said Platte Valley's Deeds of Trusts and Platte Valley agrees that its <br />Deeds of Trusts executed and recorded prior in time to said TLC's Easement shall be subject, junior, <br />and subordinate to TLC's Easement. <br /> <br />Provided, however, that nothing herein contained shall operate in any way to release <br />or affect the validity of the Platte Valley's security instruments as liens upon the Subject Real Estate <br />or to otherwise affect the priority of said Platte Valley's lien except as herein provided. <br /> <br />This Agreement shall be binding upon the undersigned and its successors and <br /> <br />assigns. <br /> <br />Executed this & day of July, 2006. <br /> <br />Platte Valley State Bank: and Trust Company <br /> <br />BY~~~ <br />Its G."'''''
