<br />David A. Senseney, being first duly sworn, deposes and says:
<br />
<br />1. That the Affiant is one of the successor cotrustees of the Arthur N. Senseney
<br />Revocable Trust dated January 26,1999, as amended on February 13, 1999 (hereinafter referred
<br />to as the "said Trust").
<br />
<br />2. That on May 25, 2006, the Affiant and Steven A. Senseney became the successor
<br />cotrustees of the said Trust upon the signing of an Acceptance to Act as Successor Cotrustees, the
<br />original of which is attached as Exhibit "A", and following a determination by a majority in number
<br />of the spouse, adult children and personal physician of Arthur N. Senseney that Arthur N. Senseney
<br />is unable to give prompt and intelligent consideration to business matters, and upon the determination
<br />by a majority in number of the spouse, adult children and personal physician of June F. Senseney that
<br />June F. Senseney is unable to give prompt and intelligent consideration to business matters as
<br />required under the terms and conditions of paragraph ( e) of ARTICLE FIFTH of the said Trust, the
<br />originals of such Affidavits are attached as Exhibit "B".
<br />
<br />3. That the Affiant and Steven A. Senseney remain the sole cotrustees of the said Trust
<br />as of that date.
<br />
<br />4. That among the assets of the said Trust is the following described real property:
<br />
<br />An undivided one-half (~) interest in and to the Northwest Quarter of the
<br />Southwest Quarter (NWv..SWv..) of Section 32, Township 11 North, Range 11
<br />West of the 6th P.M., Hall County, Nebraska;
<br />
<br />An undivided one-half (~) interest in and to the following: The Southwest
<br />Quarter of the Southeast Quarter (SWv..SEv..), the Southeast Quarter of the
<br />Southwest Quarter (SEv..SWv..), and the Northeast Quarter of the Southeast
<br />Quarter (NEv..SEv..) of Section 7, Township 9 North, Range 11 West of the 6th
<br />P.M., Hall County, Nebraska, EXCEPT 29.2 acres deeded to Roberts
<br />Construction Company, book 138, page 297 of Deeds, at the office of the
<br />Register of Deeds, Hall County, Nebraska, and EXCEPT that portion deeded
<br />to the State of Nebraska, in book 9, page 289, and in book 154, page 238 ofsaid
<br />records of 38.31 acres, and EXCEPT 11.95 acres deeded to Joseph Lilley and
<br />Charles Babel, as recorded in book 159, page 11 and book 171, page 584 of said
<br />records; and the Southeast Quarter (SEv..) of the Southeast Quarter (SEv..) of
<br />Section 7, Township 9 North, Range 11 West of the 6th P.M., Hall County,
<br />Nebraska;
