<br />200606199 <br /> <br />ARTICLE III <br />BASIC PURPOSES <br /> <br />1. This Declaration is for the following purposes: <br /> <br />a) To limit and restrict the use of each Lot and thereby convey a corresponding benefit upon <br />each Lot; <br /> <br />b) To grant a non-exclusive easement in all Lot owners for the use of the Common Area, <br />which Common Area shall be owned by the Association; <br /> <br />c) to provide for the maintenance and care of the Common Area, to approve the construction <br />and landscaping upon each Lot, to provide for the maintenance and care of lawns and yards of each <br />Lot, and to otherwise act in the best interests of the Owners of the Lots and the Real Estate; <br /> <br />d) To provide for the financing of the Association by assessing each Lot and to establish liens <br />as security for the payment of the assessments; <br /> <br />2. This Declaration and its purposes are each hereby agreed to create and confer continuing <br />benefits upon each ofthe Lots in the Subdivision and the restrictions and limitations upon the use of <br />each Lot are hereby agreed to be reasonable in consideration of the benefit received by each Lot. <br /> <br />ARTICLE IV <br />GENERAL RESTRICTIONS <br /> <br />1. The Lots are generally limited and restricted in use as provided in this Article as well as <br />being more specifically restricted by the provisions of Article V hereof. <br /> <br />2. Satellite dishes are permitted but shall not exceed thirty six (36) inches in diameter and <br />shall not be visible from the front of the residence on such Lot. Antennas and aerials are not <br />permitted. <br /> <br />3. Fences shall be constructed of new PVC material and not greater than six (6) feet in <br />height. No outbuildings or enclosures of any type or nature whatsoever shall ever be constructed, <br />erected, placed or maintained on or about any Lot within the properties, except such fences as <br />permitted herein or enclosures as may be authorized in writing by the Association. If any Owner <br />fails to repair, maintain, or replace a fence, the Association may perform such work, invoice the <br />Owner, and secure and enforce a claim and lien therefore against the Owner and hislher Lot in like <br />manner as a delinquent assessment. Any placement of flag poles, basketball poles, or basketball <br />hoops shall require prior written consent of the Association. <br /> <br />4. No commercial truck, trailer, boat, motor home, camper equipment or machinery, or cars <br />not in daily use shall ever be parked, located or otherwise maintained on any Lot, parking area, street <br />or Common Area, except in cases of emergency due to breakdown or accident. <br /> <br />5. Automobiles shall be parked only in garages, driveways, or designated parking areas <br />3 <br />
