<br />WHEREAS, T.e. Enck Builders, Inc. a Nebraska Corporation ("Developer"), Brian L. Fox
<br />and Heather L. Fox, husband and wife ("Fox"), and Gaylord L. Peterson and Beverly A. Peterson,
<br />husband and wife ("Peterson"), are the owners all lots in Via Milano Subdivision in the City of Grand
<br />Island, Hall County, Nebraska ("the Subdivision") with Developer owning Lots 2,3,4,5,6,7,8, 10,
<br />Outlots A and B in the Subdivision, Fox owning Lot 1 in the Subdivision, and Peterson owning Lot
<br />9 in the Subdivision, and
<br />
<br />WHEREAS, it is the desire of the Owners to improve the Subdivision by establishing
<br />appropriate restrictions on all lots in the Subdivision.
<br />
<br />NOW, THEREFORE, in consideration of the mutual benefits to be derived by the owners of the
<br />Subdivision, and any grantees, purchasers, their heirs, and assigns, the owners stipulate and agree that
<br />all lots in the Subdivision are subject to this DECLARATION OF RESTRICTIVE COVENANTS
<br />AND CONDITIONS ("Declaration"):

<br />ARTICLE I
<br />DEFINITIONS
<br />
<br />The following definitions shall apply to the Declaration:
<br />
<br />1. "Association" shall mean and refer to Via Milano Homeowners' Association, a non-profit
<br />Nebraska corporation, its successors and assigns.
<br />
<br />2. "Board of Directors" shall mean the Board of Directors of the Association.
<br />
<br />3. "Real Estate" shall mean and refer to Lots One (1), Two (2), Three (3), Four (4), Five (5),
<br />Six (6), Seven (7), Eight (8), Nine (9), and Ten (10) and Outlots A and B in Via Milano Subdivision,
<br />in the City of Grand Island, Hall County, Nebraska, as platted and recorded in the Office of the
<br />Register of Deeds of Hall County, Nebraska.
<br />
<br />4. "Owner" shall mean the record owner, whether one or more persons or entities, of a fee
<br />simple title to any numbered lot which is a part ofthe Real Estate, but excluding those having such
<br />interests merely as security for the performance of an obligation.
