Lindquist, a <br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", <br />pursuant to a ,power of sale contained in that certain Deed of Trust recorded on March 29, 2002 as <br />Instrument No. 0200203402 in the office of the Register of Deeds of Hall County, Nebraska, and <br />the Secretary of the Department of Housing and Urban Development, hereinafter called <br />"Grantee." <br /> <br />WHEREAS, on November 23, 2005, Eric H. Lindquist, as Successor Trustee, executed a <br />Notice of Default pursuant to which notice was given to Johnny Mulinix and Bethany Bilslend, <br />each a single person, Trustors, under that certain Deed of Trust recorded on March 29, 2002 as <br />Instrument No. 0200203402 in the office of the Register of Deeds of Hall County, Nebraska, <br />covering that certain premises described as: <br /> <br />Lot Two (2), Block Sixty-Six (66), Wheeler and Bennett's Second Addition to <br />the City of Grand Island, Hall County, Nebraska, <br /> <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting <br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfY <br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of <br />Hall County, Nebraska, on November 30, 2005, as Instrument No. 200511759. <br /> <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska. <br /> <br />Subsequent thereto, beginning on February 1,2006, Grantor caused to be published in The <br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County, <br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating <br />that the described property would be sold at public auction to the highest bidder for cash or certified <br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, <br />Grand Island, Hall County, Nebraska at 2:00 p.m. on March 14, 2006. Publication of such notice <br />was made for five consecutive weeks on February 1, 2006, February 8, 2006, February 15, 2006, <br />February 22,2006 and March 1,2006, the last publication being at least ten (10) days but not more <br />than thirty (30) days prior to the date of sale. <br /> <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties <br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008 <br />RR.S. Nebraska. <br /> <br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H. Lindquist, <br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said <br />property for sale at public auction, and did sell the same to Mortgage Electronic Registration <br />Systems, Inc. for the sum of $60,753.43, it being the highest bidder therefor. Mortgage Electronic <br />Registration Systems, Inc. has assigned all of its right, title and interest in such bid to Grantee. <br /> <br />NOW, THEREFORE, in consideration of the premises and of the sum of $60,753.43 so bid <br />and paid as aforesaid, I, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto said <br />Grantee, its successors and assigns forever, all the estate, right, title and interest of which the said <br /> <br />ame <br /> <br />". <br />te.
