Lindquist, a member <br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to <br />a power of sale contained in that certain Deed of Trust recorded on December 30, 1997 as <br />Instrument No. 97-110957 in the office of the Register of Deeds of Hall County, Nebraska, and the <br />Secretary of the Department of Veterans Affairs, hereinafter called "Grantee." <br /> <br />WHEREAS, on March 16, 2006, Eric H. Lindquist, as Successor Trustee, executed a Notice <br />of Default pursuant to which notice was given to Michael Wayne Gregory and Debra M. Gregory, <br />husband and wife, Trustors, under that certain Deed of Trust recorded on December 30, 1997 as <br />Instrument No. 97-110957 in the office of the Register of Deeds of Hall County, Nebraska, covering <br />that certain premises described as: <br /> <br />LOT NINE (9), BLOCK TWENTY-EIGHT (28), GILBERT'S THIRD <br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA, <br /> <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting <br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy <br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of <br />Hall County, Nebraska, on March 27,2006, as Instrument No. 200602598. <br /> <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska. <br /> <br />Subsequent thereto, beginning on April 29, 2006, Grantor caused to be published in The <br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a <br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the <br />described property would be sold at public auction to the highest bidder for cash or certified or <br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand <br />Island, Hall County, Nebraska at 2:00 p.m. on June 6, 2006. Publication of such notice was made <br />for five consecutive weeks on April 29, 2006, May 6,2006, May 13,2006, May 20, 2006 and May <br />27,2006, the last publication being at least ten (10) days but not more than thirty (30) days prior to <br />the date of sale. <br /> <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties <br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008 <br />R.R.S. Nebraska. <br /> <br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H. Lindquist, <br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, postpone <br />such sale pursuant to Neb. Rev. Stat. ~76-1009. Thereafter, at 2:00 p.m. on June 22, 2006, John <br />McDermott, attorney for Eric H. Lindquist, Successor Trustee, did offer said property for sale at <br />public auction, and did sell the same to CitiMortgagc, Inc., successor by merger to Principal <br />Residential Mortgage, Inc.for the sum of $54,922.52, it being the highest bidder therefor <br />CitiMortgage, Inc., successor by merger to Principal Residential Mortgage, Inc. has assigned all of <br />its right, title and interest in such bid to Grantee. <br /> <br />ame <br /> <br />r ~tvf~+V. <br />fJfi.
