<br />TRUSTEE'S DEED
<br />
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />
<br />THAT WHEREAS, under the Nebraska Trust Deeds Act, Neb. Rev. Stat. ~~ 76-1001
<br />to 76-1018, a Trust Deed was executed by Robert W. Wagoner and Kay E. Tracy, husband
<br />and wife (collectively, "Trustor") to The State Bank of Cairo, as trustee ("Trustee"), for the
<br />benefit of The State Bank of Cairo, the beneficiary named therein ("Beneficiary"), recorded
<br />on March 5, 2002, in the office of the Register of Deeds of Hall County, Nebraska, as
<br />Instrument No. 0200202436; and
<br />
<br />WHEREAS, Trustee filed for record in the office of the Register of Deeds of Hall
<br />County, Nebraska, a Notice of Default, identifying the Trust Deed by stating the name of
<br />the Trustor named therein and giving the Instrument Number where the same was
<br />recorded, a description of the Trust property, and said Notice containing a statement that
<br />a breach of an obligation for which the Trust property was conveyed as security had
<br />occurred, and setting forth the nature of such breach and of the Trustee's election to sell
<br />or cause to be sold such property to satisfy the obligation; and
<br />
<br />WHEREAS, after the lapse of not less than one month, the breach or default was
<br />not cured as required by law; and
<br />
<br />WHEREAS, the Trustee gave written notice ofthe time and place of sale particularly
<br />describing the property to be sold by publication of said notice at least five (5) times, once
<br />a week for five (5) consecutive weeks, the last publication being at least ten (10) days but
<br />not more than thirty (30) days prior to the sale, in a newspaper having general circulation
<br />in Hall County, Nebraska, all according to the Nebraska Trust Deeds Act; and
<br />
<br />WHEREAS, the sale was held at the time and place designated in the Notice of Sale
<br />which was between the hours of9:00 a.m. and 5:00 p.m., and was at the premises or at
<br />the courthouse of the county in which the property to be sold or some part thereof was
<br />situated; and
<br />
<br />WHEREAS, the Notice of Sale was in substantially the form as provided by the
<br />Nebraska Trust Deeds Act; and
<br />
<br />WHEREAS, on the date and at the time and place designated in the Notice of Sale,
<br />the Trustee sold the property at public auction to The State Bank of Cairo, who was the
<br />highest bidder; and
<br />
<br />and
<br />
<br />WHEREAS, the sale was conducted according to the Nebraska Trust Deeds Act;
<br />
<br />WHEREAS, the Notice of Default and the Notice of Sale were duly mailed by
<br />registered or certified mail, with postage prepaid, to all persons who had requested notice
<br />according to law or according to the Deed of Trust referenced herein; and
<br />
<br />WHEREAS, the Trustee has complied with all of the provisions of the Nebraska Trust
<br />Deeds Act.
<br />
<br />NOW, THEREFORE, I, as the Trustee under the Deed of Trust herein referenced,
<br />as aforesaid, in consideration of the premises and by virtue of the powers vested in me
<br />by law and by the herein referenced Deed of Trust, do hereby give, grant, and convey to
<br />The State Bank of Cairo, its successors and assigns, the premises so as aforesaid sold,
<br />to-wit:
