All Notices or other communications shall be sufficiently <br />given and shall be deemed given on the fifth day following the day on which the same have been <br />mailed by certified mail, postage prepaid, addressed as follows: If to the Issuer, at the Hospital <br />Authority NO.1 of Hall County, Nebraska, c/o Contryman Associates, P.c., 615 West 1'1 Street, <br />Grand Island, NE 68802, Attention: Secretary; if to the Company, at Grand Island Regency <br />Retirement of Grand Island, Nebraska, 803 Alpha Street, Grand Island, NE 68803; ifto the Purchaser <br />or Paying Agent, at Heritage Bank, 800 W. 3rd, Hastings, NE 68901, Attention: Commercial Loan <br />Department. The Issuer, the Company and the Purchaser or Paying Agent may, by notice given <br />hereunder, designate any further or different addresses to which subsequent notices or other <br />communications shall be sent. <br /> <br />SECTION 31. Usury. Notwithstanding any provision herein or in the Notes or the <br />Agreement, the total liability for payments in the nature of interest shall not exceed the limits now <br />or hereafter imposed by the usury laws of Nebraska. <br /> <br />SECTION 32. Recording. Company covenants that it will cause, at its expense, this <br />Mortgage and all supplements thereto and all financing statements deemed reasonably necessary by <br />the Purchaser, to be kept recorded and filed in such manner and in such places as may be required <br />by the Purchaser. <br /> <br />SECTION 33. Environmental Matters. <br /> <br />(a) Certain Defined Terms. As used in this paragraph and unless otherwise <br />expressly indicated, the following terms shall have the following meanings (such meanings to be <br />equally applicable in both the singular and plural forms: <br /> <br />"Applicable Environmental Law" means the Clean Water Act, the Clean Air Act, the <br />Resource Conservation and Recovery Act ("RCRA"), the Comprehensive <br />Environmental Response, Compensation and Liability Act ("CERCLA"), the <br />Superfund Amendment and Reauthorization Act ("SARA"), the Toxic Substances <br />Control Act, the Occupational Safety and Health Act ("OSHA"), and any other <br />federal, state or local statute, rule or regulation in effect in any jurisdiction in which <br />Company is or hereafter may be doing business or where the Project or any other real <br />or personal property owned, occupied, operated or used by Company is or hereafter <br />may be located, pertaining to health, the environment (as defined in CERCLA), or <br /> <br />18 <br />
