( "J" b herein referred to as LENDER. The parties recile and declare that: A. HERlT AGE BANK, BENEFICIARY is the owner and holder of a certain Trust Deed dated December 21, 200 I, and filed in the Register of Deeds Office of Hall County, on January 2, 2002, as Document No. 200200016 of that County, covering, the following described property: LOT NINE (9), IN BLOCK ONE (1) REPLAT OF RIVERSIDE ACRES SUBDIVISION TO THE CITY OF GRAND ISLAND, NEBRASKA. B. LENDER is about to loan the sum of THREE HUNDRED SEVENTY THOUSAND AND NO/IOO ($370,000,00) on a Note and Deed ofTmst securing such Note to be filed against the above described property. C. To induce LENDER to make slIch loan, it is necessary that the Trust Deed held by HERITAGE BANK, described in Section A above, be subordinated to the lien of the Deed of Trust about to be made in favor of the LENDER as beneficiary as set forth above as it applies to the above described properly only. For the reasons set forth above, and consideration of the mutual covenants and promises of the parties hereto, HERITAGE BANK, Tmstee and Beneficiary, and LENDER covenant and agree as follows: I. Subordination. BERIT AGE BANK hereby covenants, consents and agrees with LENDER that the above-mentioned Trust Deed is and shall continue to be subject to and subordinate in lien to the lien of the Deed of Trust about to be made to LENDER stated above. 2. Consideration. In consideration of HERITAGE BANK, TRUSTEE AND BENEFICIARY so subordinating the Tmst Deed held by it to the Deed ofTmst made to LENDER, LENDER shall make the above 3.
