HERlT AGE BANK, BENEFICIARY is the owner and holder of a certain Trust Deed dated December <br /> <br />21, 200 I, and filed in the Register of Deeds Office of Hall County, on January 2, 2002, as Document No. 200200016 of <br /> <br />that County, covering, the following described property: <br /> <br />LOT NINE (9), IN BLOCK ONE (1) REPLAT OF RIVERSIDE ACRES SUBDIVISION TO THE CITY OF <br />GRAND ISLAND, NEBRASKA. <br /> <br />B. LENDER is about to loan the sum of THREE HUNDRED SEVENTY THOUSAND AND NO/IOO <br /> <br />($370,000,00) on a Note and Deed ofTmst securing such Note to be filed against the above described property. <br /> <br />C. To induce LENDER to make slIch loan, it is necessary that the Trust Deed held by HERITAGE BANK, <br /> <br />described in Section A above, be subordinated to the lien of the Deed of Trust about to be made in favor of the LENDER <br /> <br />as beneficiary as set forth above as it applies to the above described properly only. <br /> <br />For the reasons set forth above, and consideration of the mutual covenants and promises of the parties hereto, <br /> <br />HERITAGE BANK, Tmstee and Beneficiary, and LENDER covenant and agree as follows: <br /> <br />I. Subordination. BERIT AGE BANK hereby covenants, consents and agrees with <br /> <br />LENDER that the above-mentioned Trust Deed is and shall continue to be subject to and subordinate in lien to <br /> <br />the lien of the Deed of Trust about to be made to LENDER stated above. <br /> <br />2. Consideration. In consideration of HERITAGE BANK, TRUSTEE AND BENEFICIARY so <br /> <br />subordinating the Tmst Deed held by it to the Deed ofTmst made to LENDER, LENDER shall make the above <br /> <br />3. This Agreement shall be binding upon and inure to the benefit of the legal <br /> <br />representatives, successors and assigns of the parties hereto. <br />
